Baby taken away by social services whilst in A&E

Hi

I'm new to Mumsnet but am in desperate need of help/advice or better still has anyone out there been in the same situation as me.

I dropped my 10 month old boy at nursery one morning at 8am. He was his normal self - happy chappy with no injuries. I got a call from the nursery at 4.30pm from the manager saying despite no accident happening at nursery throughout the day he had developed a lump on the side of his head but not to worry as he was in no pain or discomfort but best I get it checked out.

we picked him up and took him to a&e immediately where to our horror he was diagnosed with a fractured skull. because the injury was unexplained social services and police were called and the decision was made not to let us take our baby boy home. We are now under investigation and cannot see him unless supervised. it looks like it will go to court months down the line.

We are innocent of any neglect or wrong doing and it seems to us the nursery are obviously to blame. Understandably we are devastated and heartbroken and just want our boy home

All you can do is be honest anout everything and work with the social workers and court. Have you got a solicitor? They will obvious be able to advise too x

It must be devastating for you but they have to make sure your baby is safe. Previous incidents like this that have gone unchecked have led to children being killed so they have to be thorough.

Cooperate with them as much as you can. Were you honest about how the injury happened?

How long ago was this OP? Is your child under an emergency protection order, an interim care order, or a full care order? Have you been given a care plan? Was there a pre-proceedings meeting or a letter declaring their intention to get a care order from a court?

Save for an EPO, they can't just decide to take the child into care without a court order, and these are not granted lightly. Could you expand a little more on what happened?

Sorry, I mis read, from the original post when you said "dropped him" I thought you meant literally and that's how he got the injury. So it happened at nursery?

They wouldn't just take him there must be more to it. They would have contacted others to see what your background is like, gp for example. Unless there's more to it it doesn't sound like they could just take him. I agree with pp though about working with them.

@BlackAudi when I read a second time it sounds like she means she "dropped him off" and that he was injured afterwards somehow at nursery. Slightly confusing!

There has to be more to this than what's on this post I'm afraid.

I'm sorry it's stressful for you, but you need to cooperate, get appropriate specialist advice (which you won't get on MN becYse this will fast become an anti social services thread), be fully open with them and focus on that.

I have been almost exactly where you are now - only difference being my boy went to a childminder and it was us who noticed the lump.
You are in the impossible situation of trying to prove a negative. I can only echo the above poster who said to cooperate completely.
SS told us they don't have to prove anything beyond a reasonable doubt, but only what is most probable. In your case, the fact your boy was at nursery from 8am and the bump only appeared late afternoon may well work in your favour.
Did you happen to take any photos of him in the morning that would show no bump?

I know it's awful for you all but they really do have to be thorough. Because no one knows how it happened SS have to safeguard him whilst they investigate.

I'm so sorry OP.
A similar thing happened to a friend of mine.

Over a 'bruise' on his hand. Which after 3 days of being told she couldn't see her baby and that he had to be placed in the care of a relative was determined to in fact not be a bruise.

It's ruined her still.

For those saying there's more to this, you are wrong. My 10.5 mth old presented with a fractured skull that we had no explanation for. We were both immediately interviewed separately by police and SS and he was removed from our care with only supervised access. There had been no previous concerns whatsoever and we were eventually exonerated completely.
How dare some of you say with such authority that there has to be more to it?
