Italian court says sexual harassment ok

Sorry for DM link. An Italian man prosecuted for sexual harassment has been acquitted because the judge didn't feel his inappropriate touching of female subordinates was for sexual pleasure.

So, it's now the claimed intention of the defendant rather than the actual impact on the victim that matters?

I know we have separate crimes of manslaughter vs murder, partly due to intent to kill, but surely this can't apply to this sort of case? "Honest, m'lord, I only grabbed her boobs for a bit of fun!"

I despair.

You have to remember that it was OK to do this kind of thing back in the day
I don't mind older guys calling me honey or love as they don;t mean anything by it, it was the way people kinda got on back in those day
Everyone likes to be a victim and get a claim these days
The women he did this on could have slapped him or told him to f off, instead of taking him to court.
We are strong women, we can kick ass on old men :-)

And so? Lot's of things 'were OK' or at least widely practised back in the day that aren't OK (or even legal) now.

This being Italy though, I can't say I'm surprised. Excellent food, countryside and cultural interest, not very progressive when it come to womens rights.

women now feel they are able to speak up more but even when we do it is often questioned angry

i would talk to him first, tell him to knock it off, he is a old gent me might understand that i am offended
then i would talk to his superior and tell them he needs to knock it off
then i would tell him i was going to stab him in the balls with a pencil if he did it again
then i would actually stab him in the balls with said pencil if he did
then i would consider legal action if that didnt work

Well great for you that you're prepared to endure lengthy sexual harassment and possibly prosecution for assault in order to stop someone helping themselves to your body. I just think there should be an easier way, one that doesn't require me to shoulder the burden of someone else's actions, that's all.

OP I agree, I despair and I worry for my daughter's future. I'd like to think that the UK is more sensible than Italy but then I hear comments from British judges and realise that we're no better really.

Is this any different from the recent decision in the DJ Neil Fox case?

The judges in that said in their judgement that they were in no doubt that he had gone around grabbing women's breast etc., but that it wasn't proved to be sexual so didn't meet the definition of the offence.

(He later claimed to have been vindicated by the acquittal, but that was a very generous interpretation of the decision. In actual fact the judge publicly stated that they believed his victims.)
