Just watched the whole thing today! Seriously tragic. Probably because we'll never really know the truth.

cherryrednose · 28/12/2015 17:55

watched this over two days with ds - riveting and shocking, had to constantly remind myself that this wasn't fiction. Expect there'll be massive repercussions from this documentary.

Just finished it in 3 days.
Shocking, tragic and riveting.
I could have cried everytime Brendan spoke.

Only just finished the first two episodes but completely gripped. I'm gobsmacked at so much of it, but just at this point, that the DA's office were allowed to detail so much of the evidence found at the scene as well as saying they were sure of the perpetrator to tv/ newspaper journalists - surely this would be prejudicial to a jury?

Cocolepew · 30/12/2015 00:03

They played the whole thing out on the media, its shocking.
I think some people just wanted to be on t.v Confused

Fab watching so upsetting so unjust. A must watch for everyone.

We watched it in 2 days. I felt a bit sick and overcome with irony at this when some media person said that 'murder is hot right now'.

I binge watched last week. How did they secure the convictions?! They put everything in the press and so many holes that even the very dedicated defence didn't seem to challenge. Plus I never heard anyone try and attribute a motive to either Steven or Brendan and surely that's part of the case?

Report
capsicumcat21 · 31/12/2015 16:31

mrFMercuy The alleged motive given for Steven and Brendan was sexual.

That was part of the issue. Steven was cleared irrefutably of the original rape through DNA but ven then a lot of the local Police believed he was guilty. There was mad cop who did the original sketch in the first rape who was still saying long after Steven's release that he wasn't convinced Steven wasn't guilty. When Teresa went missing all the cops jumped on Steven as a suspect because many still clearly believed he was a rapist who'd 'got off'.

I think Brendan got dragged into it because was a good alibi witness for Steven. However once Brendan implicated himself in it then he was lost as an alibi witness.

I watched the first one last night. Don't think I can bring myself to watch the rest. He's already spent 18 years in jail for a crime he didn't commit. How much more is he going to be made to suffer?

sandylion · 01/01/2016 00:25

SPOILER ALERT Brendan is heartbreaking. That poor boy. How they could convict on confession alone is beyond my comprehensive. No evidence for what he alleged. But the whole thing was unreal! Reasonable doubt there was plenty! I hope the truth whatever it is gers out.

I've just finished watching and can't stop thinking about it. I keep having to remind myself it's not fiction.
Riveting and harrowing.

It was terrible but I couldn't stop watching it. The law enforcement officers were terrifying - their incompetence was only eclipsed by their utter contempt for the law and procedures. Brendan was pitiful - he understood practically nothing, and this weakness was used against him. Shocking.

Report
Cocolepew · 01/01/2016 11:06

When Brendan said in the phone call to his mum the police said his story was inconsistent and then asked what it meant I actually cried.

Report
IguanaTail · 01/01/2016 12:52

Just awful. I was really upset when he asked if he would be able to leave by 1.29 as he had to hand in a project at school.

Also, when Avery said that Brendan "wasn't very bright" and then Kachinsky suggested this was a coded threat from Avery to Brendan to stick with the story. Yeah. As if Avery was bright enough to do that. And as if Brendan would be able to understand even if he did.

Report
msrisotto · 01/01/2016 14:54

Yeah, when she asked him how he knew the details of the murder and he said he guessed, like he does with his homework. I felt so very sad for him.

MrFMercury · 01/01/2016 17:06

But it seemed to be presented as they suddenly decided to rape someone. That's a big leap especially when they said she was chained to the bed. I never heard them present evidence of chains, damage to the bed etc. There was one bit where one of the lawyers alluded to incest and the Averys as being just all round bad but that was it. Plus I thought she'd been to photograph vehicles before so she wasn't a total stranger. I don't know their whole case was based on what they'd decided had happened and making facts to fit rather than investigating with an open mind. Plus so many things, like the key being found on the 7th search in plain sight just leave me unable to understand how they were convicted. It's so blatant!

MrFMercury But part of the issue was that most of the community and Police were already very biased against Steven. When they were at the voir dire stage trying to select the jury they were struggling to find anyone who didn't already believe that he was guilty. Unfortunately in the US the press is allowed to report a lot more prior to trial than we would in the UK so it is then difficult to find a non prejudiced jury. This is only slightly countered by the fact the prosecution and defence have more control over jury selection than we do in the uk. However there seemed to be a significant number of people both in the community and amongst professionals who came from a starting point of Steven being guilty who then will just ignore anything which doesn't fit with their biased view.

Yes as presented there were more holes than a Swiss cheese however you have to remember that we didn't actually see the full trial. We just saw what the documentary makers wanted us to see so we can be as potentially manipulated as viewers as the jury were. Also the jury may not have been in possession of as much information as we the viewer. It may be that the defence did challenge the issues around the lack of blood, lack of chains lack of any forensic evidence to suggest Teresa had been in the trailer and reasonable explanations given? Or the jury just decided to ignore these fact because they wanted to believe Steven guilty.

IguanaTail · 01/01/2016 18:33

They said for Brendan's trial that she was murdered in the bedroom of the trailer. Tied up and stabbed to death. Yet not a single drop of blood, or strand of hair, or fingerprint or anything at all placing her DNA was in that room.

They said for Avery's trial she was shot 8 (?) times in the garage. Yet in that incredibly cluttered garage, with cement cracked all the way down the middle, not a single droplet of blood was found there either. How easy would it be, even as a trained scientists, to sterilise totally that area?

NoonAim · 01/01/2016 18:40

I agree. I'm not so convinced of their innocence having watched all 10 episodes as I was in the beginning. However, there is no way they should have been convicted on the evidence that certainly looked to have been planted by the prosecution.

I do feel very sorry for Brendan though, his 'confession' was written for him.

Some Twitter sleuths have examined pictures of the RAV4 and think that some damage is consistent with it being pulled out of a ditch. lots of theories online about Brendan's brother Bobby and his mums husband Scott someone actually being responsible too.

It was heartbreaking to watch however completely compelling! I can also recommend The jinx - an 8 part serial about Robert Durst which is equally gripping

I have read some commentators that think Steven is guilty but still think the trail was unlawful and biased.
There were accusations that the filmmakers left some of the more unsavoury parts of Stevens past out of the film but they have addressed those points in interviews.
I thought that Brendans brother and Stevens brother should have been looked at more closely.

The trail really should have been much further away from the town.

I really couldn't stand Kratz and his weird delivery, or the policeman(?) who still refused to admit that Steven was innocent of the rape.

The press conference that Katz did where he went into detail of what they thought had happened where he went into intimate and gruesome detail was just bizarre.
