Want to sell fake bag on ebay. Advice please.

I have a brand new fake designer bag which was bought form China. I never use it and want to put it on ebay. I would never put it on as authentic although there are plenty of fakes on there! Will list it as Chloe-style. Is it ok to do that?

sounds fine as long as you mention that it's from china and not authentic.

I think they might remove it anyway - not sure what their policy is, even if you are totally honest they might have a general ban on anything fake.

Have a look in the help section on the site or email them and ask - though no guarantees of a relevant reply!

I sold a set of fake global knives on ebay, put "global" in the title but clearly explained that they were not all they seemed to be and that was fine.

I once had something removed though because I said it was "like" a certain brand in the title.

You cannot sell counterfeit goods, however much you describe it as such.

Yes you can ( although you're not supposed to), it's not illegal.

eBay say...

"Counterfeits, unauthorised replicas (such as counterfeit watches, handbags, or other accessories) or unauthorised copies (such as copies of software programmes, video games, music albums, movies, television programmes, or photographs) are not permitted on eBay. Unauthorised copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorised copies of media.

Guideline: If the product you're selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it on eBay.

Breaches of this policy may result in a range of actions, including:

  • Listing cancellation
  • Limits on account privileges
  • Account suspension
  • Forfeit of eBay fees on cancelled listings
  • Loss of PowerSeller status

    What about replica coins for collectors?

    Any "reproduction" "replica" or "copy" coin (UK or foreign) must be plainly and permanently marked with the word COPY."

I'd suggest listing it as 'definite fake, unwanted gift' and seeing if you can get away with it asthey are unlikely to shut your account for a first offence.

why don't you sell it on here? Is it nice? Put a picture on and who knows you may not need to bother with ebay. Uh oh I can feel myself wanting to but it already!!

I once grassed somone up for selling me a fake CD on ebay. I was so pissed off.

I contacted FACT & EMI
He had his ebay account removed.
EMI sent me a load of free CDs for reporting him.
I got a refund via paypal.
I'm not sure what happened to him!

This was obvioulsy pre children when I had far too much time on my hands!

It's a black Paddington Chloe copy with padlock, key and all the tags on. Definitely leather! Am rubbish at doing pictures but will try. Thanks for advice. Don't want to get into trouble (scaredy cat!)

If so, it is counterfeit. You cannot list it on eBay or sell it in any way.

Referring to the eBay rules posted by hotCheese: "Guideline: If the product you're selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it on eBay."

It will be a breach of Chloe's trademark. Chloe is one of the most litigious brands in protecting their trademarks. It is standard practice for the big brands to employ people who trawl sites like eBay for counterfeit goods and copies. If eBay does not remove it, they will ask eBay to. They can also sue you if they choose. The fact that you describe the goods as not authentic is even worse for you legally because you are knowingly selling it as a fake.

Ok blueshoes, that's it, not putting it on! Don't want to lose my ebay account. It has got Chloe stamped all over it. Would have felt very uneasy putting it on.

Is it definitely leather? If you were being very critical what make sit look fake? (apart from the obvious that it is and its from China )
