We won the tribunal !!!!!!

Can't believe it - in shock! This started from when we had a 8.5k a year placement as our first school choice. LA played their stupid games and the offer of a place withdrawn on the final day of submissions so we had 24 hours to find an independent placement which we have won.

So a year of stress which could have been resolved months ago without the need for tribunal - cost to us 3k and heaps of stress.

Cost to LA was originally going to be about 20k if they had gone with our first choice of placement, cost to LA now 70k a year for the placement plus the cost of hiring a solicitor and barrister to take us on - I did it without any legal help but the power of mumsnet.

Would like to say thank you to each and everyone of you for holding my hand through this journey. Just shows that David can beat Goliath.

The journey not over for me as now the complaint process starts but that can wait for another day smile

Congratulations, brilliant news and well deserved. Have a WELL DESERVED rest now, as you have been to hell and back, due to the LA.

bochead Wed 27-Feb-13 13:11:51

Yes!!!!!!! I'm so happy for you!!!!!!!!

That's wonderful. I firmly believe that every individual victory is a stepping stone in the right direction for ALL our kids.

Be prepared to "crash" over the next few weeks though, as the acculumated stress catches up with you. Plan a chillax weekend and a long bath when it hits.

What a waste of LA resources though - why can't these people just do the right thing in the first instance instead of having to be forced at every turn.

Scottishdancer Wed 27-Feb-13 13:16:13

Well done. I am so pleased for you.

do take some time to absorb this news - in some ways it is similar to taking time post dx to absorb and let it snk in. but today is a day to celebrate - what fantastic news!

wasuup3000 Wed 27-Feb-13 13:41:44

Brilliant!! ;)

flowwithit Wed 27-Feb-13 13:49:33

Great to read this positive news what a success well done!
Hope you can relax a little and celebrate now your hard work and persistence has paid off, fantastic!

AgnesDiPesto Wed 27-Feb-13 13:57:00

Hurrah! I had a hunch but you never know with panels so its good to have faith in common sense restored. We started off asking for £7500 part time mld nursery placement and ended up with £50k ABA in mainstream all because LA insisted ds was too bright and mild for SS. Glad the game playing blew up in their faces. Don't expect their attitude to change our LA treated us as tho we had bewitched the panel and lied to win to avoid accepting any responsibility. The best thing is you can now cut out of your life all those profs who did not help you. Right now go book the spa you missed out on. You deserve a total blow out.

moosemama Wed 27-Feb-13 14:05:11

Fantastic news!!!

When will these LA's learn??

zumbaleena Wed 27-Feb-13 14:21:54

Oh brilliant bjk! Honk honk

Well that brought me to tears!

We're all so incredibly proud of you.

If you can afford it in anyway, spend a couple of hundred on some indulgence.

Honk! grin

We started off simply asking that DS' already allocated TA be trained in ABA and a bit of consultant time. About £2k.

Ended up with a £35 placement with transport.

£35k.

If we had lost that they woukd have justified their legal team by saying they had 'saved' £35k, when actually all we ever wanted was a decent TA and a bit of access.

sunshine175 Wed 27-Feb-13 14:46:42

Congratulations all your hard work has paid off.grin I am so pleased for you.
Your story has given me courage to keep pushing for better provision.

You know what I'm gonna daydream of?

LA's solicitors face. I think I might even toast her. It was one mighty performance.

Perhaps you could send a rotten carrot to the LA solicitor smile

Brilliant news, I'm so pleased for you. I hope you are out celebrating. wine

bjkmummy Wed 27-Feb-13 18:48:37

let me share some snippets of the judgement with you:-

we have concerns re the LA proposals for J to attend mainstream school. That offer appears to have been made very much at the last minute and did not give the impression of having been carefully considered and thought out in detail.

that about sums up my tribunal - LA thought they could just turn up and throw a placement never discussed before and thought they could get away with it! thing is the tribunal were so poker faced that we could not read it and we were sure that we couldnt win because of the cost. the head of the independent school phoned today and she thought we may have lost as we hadnt contacted her and also because so much was made of the costs at the time. the ruling concludes that the school the LA suggested was simply not appropropiate so therefore out school gets it smile

the LA are of course so far absolutely silent grin

been and got a bottle of bubbly for me and dh to share tonight when he gets in from work

2tirednot2fight Wed 27-Feb-13 18:55:52

How fabulous, just goes to show there is still hope, well done bjkmummy

Well the LA are of course whinging about a biased panel and a devious mum......

ha ha ha ha ha ha ha

pinkorkid Wed 27-Feb-13 19:01:41

Excellent - great that they saw through the LA's shenanigans. Enjoy the bubbly!

nennypops Sat 02-Mar-13 10:38:53

Great. Wasn't that LA solicitor the one who told you you couldn't possibly get OT in the statement and you couldn't possibly win? Let's hope she's learnt something.
