School say they can't meet needs

Am looking for advice on what to do next. Dd in mainstream school. School say can't meet her needs anymore. Am getting lots of incident reports and also photographs sent home showing injuries staff have from being pinched and scratched. I would like her to go to specialist independent school. Do I need to call an early annual review and ask for another school to be named? Should I visit local special schools to rule them in or out even if I already know where she should go? I know that I am heading for tribunal to get independent school but just want to get on with it as school are succeeding in their plan to depress me into removing her. I know they don't want her and all the negative stuff is evidence collecting on their part.

Yes do all of that. I was in the same position 2 years ago.
Call an early review.
Look at local ss as this is likely to be what the LEA offer. They may even offer a unit or PRU if you have them.
I know it is depressing but the evidence all adds up to the case for the indie ss.
You will have to prove that the indie ss is the only one that can meet her needs.
Look at what therapies she needs but can't get access to in the LAs choice. Consider whether the peer group is appropriate for her. Are class sizes small enough. Are staff experienced enough. Are her peers working at a similar level in the LA's choice. Can they deal with her behaviour etc etc.
Usually if you are amending part 4 of the statement then you should also amend parts 2 and 3 to show that her needs have changed so much that ms is not appropriate so appeal all 3 parts. Make sure that part 2 is up to date and that all of her needs are in part 3.
It's a long hard slog but is worth it when you finally get the right school.

How old is DD? Do you know if she's due to transfer to an EHC Plan in the near future?

I'd get looking at those indi schools now. See what they can offer. How much they cost, how much the LA SS cost etc.

I know most people in my LA got into indi when mainstream failed. A few was made to appeal. Most never made it as far as a hearing.

It's hard but keep going to back to the school with emails to say "how can we prevent this?" What more can you do?" If the answer is "nothing" then the LA can not reasonably expect to place in another ms school, and your halfway there
