Evidence deadline - nothing from the lea

Deadline has passed but I have not had one piece of evidence. I'm presuming they are going on reports I have already seen. But should they not be sending me copies of everything they send to sendist? If so they haven't submitted any evidence?!

is this the final evidence deadline 2 boys? I think they only send you what they have sent to sendist so if you've got nothing then they've probably sent nothing....... in the next 2 weeks you get the bundle and that includes everything the tribunal has received from both sides.

im keeping everything crossed for you x im watching yours as im following you - my next deadline is in 3 weeks where the LA respond - ive already been told they are fighting it all the way.

did your LA take your childs views?

I don't know if they took his views. They didn't last time and they backed down but sendist said they threw the case out as they didn't ask for his views. I think my lea has forgotten and made a balls up

that could be another good sign then - I think my daughters may have been taken without my consent as she has mentioned about the TA asking her quite detailed questions but she did it on a computer and she says another child also did it so who knows! will see if they produce anything

Did you file the annexes to the statement? They may be relying on the reports in the annexes.

i would contact sendist on Monday - LA can be known to send everything to sendist but strangely forget to send it to the parents!

If the evidence they've gathered supports your case (rather than their own) it'll just sit on a LA desk. It might be redrafted updated -modified corrected for accuracy several times, then brought along as late evidence on the day.

Am I reading that right Meir? Out of 3600 appeals the lea's only won 117???? If they re write the formal reports to suit their needs I will rip them a new arsehole. They won't beat me with that kind of crap, solicitor or not. My blood will literally boil after two and half years of their time wasting penny pinching poo

Manish thanks. I hope they don't get an adjournment as I already got two extra months when i lodged because I have just given birth. I requested in April and tribunal is oct so I would hope sendist refused any extra time for the lea. I emailed the lea and cc sendist the day after it was late but I will phone both tomorrow

Don't read too much into those stats, OP. I think the tribunal counts an appeal as decided in favour of the appellants even if only a couple of words in the statement have been amended.

Phoned sendist - lea have sent nothing. Looks like it will be evidence on the day. Do I phone the senco up and tell them no one from the lea is to assess him from now until after the tribunal? The lea will not reply to me AGAIN!!!

I would speak to the school and say no one is to see him without your express permission which is what I have already done and also briefed my daughter as well that she is not to get 'hoodwinked' if a strange person appears at school. a couple of weeks ago she came out talking about how the TA was asking questions about what she liked/disliked about school which worried me and I though the school are taking her views for the LA. but then she said another child did it as well, spoke to that childs mum and she said it was for the school to plan for them both for the next term, my daughter bless her did go and ask the TA why she had asked her the questions and tA said the same so was nothing sinister at all (hopefully.....)

what further evidence do think the LA may and get? who are you taking to the appeal with you?

im trying to think back to my refusal to assess one and im sure the LA didn't send anything else at the final deadline either - they went on the bare minimum hence why they lost

They can call anything else in. Unless they get a full slt report which would be suicide for them as they have three reports done by their spec list teachers which show how bad it is. Maybe they just try to rip mind apart?

They can call people in to observe and there's not much you can do about that, but they need your consent to carry out a full assessment

If they produce new evidence on the day of the hearing, tell the panel you object strongly to it being admitted. The evidence deadlines are there for a reason, and you're entitled to know about it in advance to enable you to prepare your case properly.
