LA conceded at hearing!!

Just in case anyone has missed the other thread WE WON grin and I have been waiting so long to write that thread title.

In 10 months we have gone from a 2nd refusal to assess to a statement to placement in OOC specialist indi school.

Don't be put off by refusal/dismissal but keep on keeping on.

I am still feeling a little numb. I keep reliving the hearing and it only lasted an hour and a half and so I can't imagine the mental torment of an all-day hearing followed by a wait for the ruling. FS mentioned one case where they had waited 5 weeks before being told that they had won.

I have to say that on the day the presence of FS made all the difference. I would have been in a huge panic over the no electronic WD thing. FS was not to happy about the judge that we had and so it was an advantage to have panel taken out of the equation. I don't think that would have happened and that the LA would have conceded without FS.

It was FS rather than the judge that ran the proceedings. Despite the LA having the only electronic WD it was FS that went through it page by page whilst the panel scribbled amendments and asked her to slow down. Additions/deletions that did not impact on provision were instantly agreed (whilst apologising to the panel at how this increased the list) plus 'but these are his own views - why would you want to delete them?', 'why would you want to delete your own expert?' plus my personal favourite 'oh right, because ASD ends at 3.30'.

I went with a tank kitted out with WMD rather than a sling-shot. It was like David -v- Goliath with the LA in the role of David with a rewrite where David is the baddy and is annihilated grin

I've read on here stronger cases/equally strong cases. Winning is not about being morally right.

In fact, at the end of the day, despite the number of women who work in the SEN 'industry', it all seems to come down to 'mine's bigger than your's'.

I am so pleased. I have enormous respect for FS who, although not a lawyer, is hugely experienced and very pragmatic. But more than that, she gives 110% for the children and is very passionate about getting things right for them.

Well done I am really pleased for you.

We had FS as well and I agree with you she is brilliant. Unfortunately we lost, but she couldn't have done more. We were there until 5.30 and when we left everyone thought we had won including la. what happened between there and decision I don't know, but we are going to appeal.It is good to hear of a case where justice is done.

SD - it may interest you to know that in the hearing they wanted to hear about CA as a day school alternative and in the short bartering session whilst the LA were conceding they asked if I would consider again CA or a m/s indi school with a unit.

Perhaps it would have been tactically advantageous to name more expensive, boarding provision that you did not really want. hmm On the other hand, you should be aware that the odd decision might have something to do with the provision you named (neither sites were rated by one of my experts). Then there is the unpredictable idiosyncratic rulings of the panel - FS mentioned that she had recently lost a case that absolutely should have won - probably you sad. Don't give up, you will win eventually smile

I am off to Tribunal in two months time. It is very heartening to hear of a good result. I have been fighting for my DS for 18 months now and am worn out with it all.

The 5 week wait for the answer with FS was us! Well worth the wait but huge stress.
