I got word today my 2 sons appeals have been refused even though we explained my older son suffers anxiety attacks and needs to be near familiar people and as he knows several friends at this school which is a 2 min walk from our house ( we moved in from Eire back to my home town 2 weeks ago) we feel this condition is serious and has prevented him from attending school last year now he has to travel to another school where he knows no one i am gutted and worried how my son will react when sept comes .I was wondering can i reappeal the decision it was based on overcrowding.
Thanks

I don't know for sure but I think you can only appeal (via Ombudsman) if the appeal itself was not carried out properly.

I'm sure someone much more knowledgeable will be along in a minute, though. I hope there is something you can do.

You are only allowed one appeal to an independant appeal panel per school year unless there have been material chnages in the circumstances of the appealant or the school.
You could therefore appeal again in September but unless you have some very good reasons I would say you are just wasting the one opportunity you have. I would leave it till at least Christmas, so that you can say that you have given the alloted school a chance.
If you are only a 2 minute walk away and it is community school then I would say that there is a reasonable chance that you will be very near the top of the waiting list and you may get a place offered as others leave the school. Have you confirmed with the LA that you are the waiting list for the school and any other schools that you think are OK.

I'm in the same position as you am gutted my child didn't get in to the same school as a older child is attending.we lost the appeal now will have to go to three different schools.
I am at a loss about what to do as my child is very upset and does not want to go to allocated school.
