Sorry long!!
I have been working at a coucil run school nursery as a TA since April 2008, I have had temporary contracts renewed every 6 months or so.
I didn't think my contract ending August 09 was going to be renewed so booked a holiday for the October of that year. The contract was subsequently renewed and they honoured the termtime holiday which mean't I was off work for six working days and four weekend days and didn't get paid for this time.
The nursery is closing in July and previously was told I would have the same redundancy rights as permenant employees due to continuous service with a break of no more than two weeks.
However now they are saying this constitutes a break in employment so am not entightled to any of the redundancy benefits.
Is this right? I feel they are going back on what has been previously been agreed.
