Anyone out there know anything about "To Let" signs

Hi there, just need to clarify this with those in the know:

I own a first floor flat with 50% of the freehold, as does the landlord down stairs.

I do not wish him to leave his advertising board 365 days of the year in the communal front garden and have removed it a number of times!

Things have come to a head now, and I need to find out where I stand legally as he is threatening to take me to court for removal of said board Sad

As far as I can see from my research on the internet is that as I am part owner of the communal area I have a right in what goes on in said area.

Can he legally leave it up, as normally it should be removed after 14 days of the new tenant moving in, the current tenant has been in there for over a year and he is just using it as an advertising tool rather than trying to fill the property. (I would feel quite differently if he was trying to sell the property, and agree with the board being placed in the garrden)

I feel quite strongly about this as the flat is my home, and I maintain it to a high standard and in my opinion the board makes it look trashy.

Can anyone answer my questions or is it a really obscure area?

There is a law about how long Estate Agents' boards can remain in position after a sale or letting has completed. I am not sure exactly how long the period is, but three weeks rings a bell.

Is it an EAs' board or a private one?

It is an estate agents board, the son owns or works for the EA and his dad owns the property.

Owner says he has a photo of me removing the board, am seriously stressed about the whole thing, I can hardly sit still for worrying. Sad

Right, I'm off to do a bit of research. Will be back in a while with the name of the bylaw (byelaw? by-law? bye law?) that EAs boards comes under. Don't be stressed.

Have goggled and the general consensus is it must be removed after 14 days, does that mean I am within my rights to remove sign, and can he do anything about it?

Back now, am quoting this from a local forum I visit

"If you see a board that says "Sold" or "Let" that's been up for more than 14 days you should remind the estate agent to take it down as it's breaking the law (Town and Country Planning (Control of Advertisements) Regulations 1984 I believe)"

In your shoes I would read up a little bit on this law and then remind them about it verbally or in writing before physically removing the sign, which comes across as a bit petty and arsey, imo.

thanks name change, I am beginning to calm down. Smile

I think I will refrain from doing anything until they put it up again and then I will write to the EA giving the bylaw details and then to the council complaining about the sign being left up for 365 days.

I am much better at letter writing than remaining calm on the phone.

Yes, speak to the council. They will talk to the EA.
