Daughter hit by cyclist on pavement

I wonder if anyone can give us some advice. My 5year old daughter was hit by a cyclist riding on a pavement through the parent and child parking bays at our local Sainsburys. She was badly cut and had to have her mouth and lip stitched under general anaesthetic. The surgeons have done a great job but she will be scarred.

The store manager has contact us and says because it is so rare they do not intend to do anything. We would like them to put up cyclist dismount signs on the entrances to the car park and to police it a little more carefully. Any suggestions on what we could do next would be really helpful.

Your poor DD, I hope she recovers quickly.

Did the cyclist stop? If not do they have any CCTV? Surely as a minimum they could put "No Cycling" signs on the pavement?

Hmm, not sure if this is a joke ( due to mention of P&c spaces) but if not I'd probably sue.

Sadly this was not a joke! I am getting no joy from the supermarket on signage so my next step is to go to our local MP who is also secretary for transport. If anyone has any info about similar accidents I could take to him that would be really helpful.

How horrible for you and DD, hope she is feeling a bit better. Did the cyclist stop? If you have legal protection on your contents insurance or similar I'd get legal advice, Sainsburys may well be liable. A solicitor's letter may help them focus their minds.

Have you reported it to the police? Were there any other witnesses apart from you?

On the whole, cycling on a pavement or footway is unlawful. However, the police are advised to, and should, exercise discretion when issuing Fixed Penalty Notices for the offence. In particular, it is emphasised that a distinction should be drawn between cyclists whose behaviour endangers pedestrians and those who act out of concern for their own safety without being a threat to others.
