Does paying half the mortgage count as maintenance?

My crap ExH pays half towards the mortgage of the house we own jointly and I live in because he refuses to sell it. (He still thinks he's coming home!)
Just wondered if this counts as maintenance? I would be happy to sell up because I would be significantly better off financially but obviously not something I can do without his joint agreement.

Should have also said-I live in the house with 1 year old DS.
ExH has DS every Saturday 10-6!

Dh currently at advice of solicitor pays half of mortgage in lieu of maintanence as otherwise if he paid me money direct, I could not meet mortgage payments and survive

My maintanence is swallowed up by my mortgage.
But my exh basically keeps a roof over our heads
I think you will have to try and make him see sense here but saying that the housing market is so bad atm.
my house has been up for sale for 18 months now,and believe me trying to maintain a reasonable standard of tidiness on top of the every day family things is hard work
