Dropping charges

A friend of mine was arrested for criminal damage in the home when her partner called the police. She's currently out on bail but her partner is trying to drop the charges so she can go back home. Bail conditions say she can't contact him or go back to their house. Will the bail get dropped when he drops charges? And is it possible to drop the charge? He's being messed about by the police saying the officer who's dealing with it isn't in until later then when he rings they keep saying he's not in yet etc etc (been going on for 2 days now).

If the charges are dropped then the bail conditions will be cancelled. However, it is not up to him to cancel the charges. It is up to the CPS whether they drop the charges or not. If they are confident they could get a conviction without his witness testimony then they may well continue with the prosecution.

There's no such thing as a victim "dropping charges" in England. The police will investigate and, if they think there's enough to charge, will pass a file to the CPS who will make a decision. Her partner can retract his original statement, but the CPS can still choose to proceed if they think a conviction is both achievable and in the public interest. This case will be classed as domestic violence, which is likely to increase the chances of prosecution.

If the case is discontinued, then she will no longer be on bail and can return home/resume contact.

It's a bit rich to complain the police are nessing him about, when he's the one calling for help one minute and reconciling the next.

Regardless of whether the bail conditions get dropped, is it a good idea for her to go back? If things have got to the point of police being called, and her getting arrested, it doesn't sound like a healthy happy relationship.
