Dispute with driveway contractor

We had a new driveway laid in July for £6500. Shortly after the driveway was completed we noticed that a number of the bricks were damaged and shouldn't have been used. After many months of phone calls and texts the contractor showed up today and said he wasn't going to fix it as it was an issue with the supplier of the bricks and they need to pay for the bricks to be changed (approx. 10-20 bricks) My contract surely is with the contractor and its up to him to make a claim against his supplier surely, not me. Net result is that 3 months later, the driveway hasn't been put right and we have paid the contractor in full (more fool us). What is the next step for us? Would be grateful for any advice.

It depends on your contract with the builder. Assuming they sourced the bricks for you, then I'd reckon they were the supplier. If you chose the bricks and they simply picked them up from the merchant for you, it might be different.

Sounds like one for the small claims court.

Thank you Collaborate... The builder ordered the bricks so we have sent them a first letter ... small claims court if no response....
