Myself and STBXH have agreed a consent order between us and I, as the petitioner, have asked a solicitor to draw it up and submit it. I did the divorce myself to nisi stage.<br><br>The consent order is a bit confusing as i will remain in the house with ExH paying half the mortgage until joint debt is paid off. There is 32K equity in the house but until joint debt is paid off, i cannot get a mortgage alone for the property.<br><br>The loan is an utter bastard one off the back of a 110% mortgage we had with NRAM. The balance atm is 22K <sob> at 12.79%, it is still too large to switch at the moment but i will as it comes down. I am overpaying considerably to get rid of it and instead of it taking 25 years, it'll take until mid 2019.<br><br>ExH earns 30K, I earn 42k.<br>Mortgage is 1K per month<br>Joint debt 600 pounds per month<br>Life insurance 60 pounds per month<br><br>I will be responsible for all costs, including our three children and he is to pay me a global maintenance of 1K per month (covering all childcare, maintenance, mortgage, debt ) until joint debt is paid off and then I will release him from the mortgage and he will pay the child maintenance. <br><br>His take home (after tax and NI) is £1970 (he also has £500 expenses a month BUT this is not included on the forms) Mine is £2600 (minus £188 for a student loan each month that I never see as cash, again, not included on the forms)<br><br>ExH has not and doesn't wish to consult a solicitor. <br><br>I have signed a disclaimer that the solicitor sent me to say that she has just drafted this form and has not advised me on whether or not it is fair.<br><br>Now I am worried that she thinks it isn't, ExH is in total agreement. The children reside with me and see him every other weekend. <br><br>Can anyone tell me if they think this is fair or not in the eyes of the law and whether or not a judge is likely to pass it? I'm nervous as funds are low and i've spent so much on this now, i just want the whole business to be how [end of my emotional tether face]<br><br>We are both in agreement and have been the whole time.
