Ex is refusing to comply with the Court Order I obtained very recently which Orders the jointly owned property (which he lives in) to be sold immediately as per my Tolata application.
I plan to complete a N244 tomorrow morning and attend Court to get an urgent hearing. He refuses to pay the mortgage and it is nearly being repossessed. I informed the mortgage lender I have Order of Sale and they've agreed to suspend repossession for 90 days so I can sell quickly. Ex obstructing sale and not complying with the Order could mean repossession and financial ruin for me!
What do I ask for? Current Order states we both have conduct of the sale, so Estate Agents can't market it without his agreement - which he won't give, so should I ask that they Order I have sole conduct? What about access - if he won't give me keys how do I let the Agents in to photograph and do viewings? He doesn't care about breaching a Court Order. Can I ask that he is Ordered to vacate the property so it can be sold easily and quickly.
I am representing myself and I know how to do the application just not what options are available to the Judge and what I should actually ask to be included in the Order to stop him being able to obstruct or delay the sale :(
