people parking in my owned car parking space

I live in a bungalow that is attached to a larger house which has been converted into flats all the occupants of the flats are tenants but I fully own my property.

Just outside my house are the parking areas, there are 5 parking space with mine being outside my home and the others are opposite.

Since new tenants moved into the flats someone has been parking outside my house, I put a note on their car to warn them that the space is not part of the parking for the main house but is the parking space for my house and is actually owned by me.

I had not used the space until this weekend when I bought home my first car I parked it in my space on Saturday, I then had a visit from the person who has been parking there and she told me that the space had been allocated to her by her LL. I informed her that it was not her LL parking space and that I had paperwork to prove that the space is my property and that she is not allowed to park there.

All kicked off on Sunday with the LL coming round saying it was part of his property, I showed him the sales paperwork which clearly showed the boundry of my land and also the search that my solicitor made which made it clear that the space belongs to the bungalow and not the house.

He is disputing this so I have told him to contact my solicitor ( who I am going to brief this morning) in the meantime I have told him that if his tenant parks in my space they are trespassing. Is there anything else i need to do or anything I need to ask my solicitor.

In the meantime my car is going to be parked outside my house and I wont be able to use it until the matter is sorted, just to say that the road outside the main house is strictly no parking

If you have all the correct legal documentation to prove you own the space, how can he dispute it? What are his grounds for dispute?

Was he maybe just angry? I really hope you get this sorted easily and without too much cost.

Has he got paperwork showing that its his then? If not then I would buy a bollard for that space to keep it free when you are not there, and start using it.

Not sure chubby, the LL only bought the house 10 months ago I have been
there since 2010 it may be possible that the old owners mislead him and he really thinks all the parking areas are for his flats or that he thinks my own paperwork is wrong. The solicitor I used when I bought the property is in London but he is going to check his files and contact the solicitor of the people I bought the house from. In the meantime I am leaving my car where it is. I have already had the man who has been parking there round to tell me that my car had better be moved or else.

Is it marked on the title plan at the land registry? You can download a copy for a few £ from the website.

Has he said that in person or in a letter? I would gather information and pass it to the police, sounds like you are being harassed.

For a few quid you could get the land registry details both for your house (sounds like you already have these), and the LLs - double check that the land wasn't re-registered incorrectly (stranger things have happened)

Sounds like there's going to be a bit of a battle though.

This happened at our old place - LL had paperwork to say that the space outside was ours and we were to use that, but next door also had paperwork showing it belonged to them.

Both got solicitors involved, and we started parking elsewhere because next door and the LL (who didn't live far away) started parking in the space as soon as the other moved their car.

It still wasn't sorted when we moved 9 months later. BT

So, you moved in 2010, but never used the parking space infront of your house until you bought your first car last Saturday?

LL bought the house 10 months ago and assumed the parking space infront of your house belonged to him as it wasn't used by you?

I assume then there is no fence separating your land from his?

I do hope the land registry has the correct boundary line shown on the drawing of yours and LLsHmm.
You should have all the details when you bought the bungalow in 2010.

I had a similar problem at a previous house. I had the paperwork with boundaries clearly shown but the person disputing it was a big bloke who tried everything short of violence to intimidate me. When it came to arguing, I found that the best way was to speak slowly and quietly but keep repeating the same thing - e.g it is my space and I have the paperwork to prove it - over and over again. Without raising your voice. I just kept this up for about two hours & he had to eventually back down.

Watching with interest, as my parents are having a similar problem with a mad bint who thinks she owns the entire street neighbour. My brother is their ll , but lives abroad so I will have to get him download the drawings from the land registary.

Looks like its getting sorted My Solicitor has all the paperwork including
land reg docs which shows the land belongs to my house, he has sent everything to the LL solicitors.

Had a call from the LL and he is in a bit of a mess, the house has 4 flats each with a parking space, and this was on the paperwork he had when he bought the property BUT he was told verbally by the old owners that I never used mine and it was always spare. Therefore he had given my space to one of his tenants who is a 2 car household and charged them more in rent.

Frankly the guy is a bit of a plonker and not a professional LL, but that aint my problem. He is going to have to speak to his tenant tonight and tell them that they cant park outside my house.

Funnily enough before he bought the property no-one ever parked outside my house on a permanent basis just the odd visitor to the flats.

Waiting for chap who was using my space to come home if he rings my bell I am going to tell him to f right off

No he's not a plonker nor in a mess. He tried to bully you into believing it was part of his property. Even when shown the legal boundaries he stated he disputed it.

Now suddenly he seems to remember he was told your space belonged to you but was always spare. He has been purposely and consciously making extra money out of property that didn't belong to him. He has known exactly what he was doing all along.

Do not spare him any sympathy - he was trying to bully you and encouraged his tenant to do the same. Fuckers!
