re Ending fixed term rent agreement

I have a fixed term assured shorthold tenancy agreement my contract clearly states' One months written notice is required by both parties to terminate this contract with effect from the rent due date with the exception of a break clause and the terms therein'. I dont have a break clause; ive given my landlord one months written rent and she wont accept it saying i have to live out the fixed term??? i could understand her point on it been a fixed term contract had the contract not clearly stated the notice period;;; can anyone advice please?

When did you sign the contract, and how long is it for?

Generally your notice would only be given AFTER the fixed term period ends.

Your landlord is right, you can't give notice to expire before the fixed term has ended, and a fixed term has to be for a minimum of 6 months. Your landlord wouldn't be able to serve you notice before the fixed term ends either. And also, your landlord has to serve you two months not one. But you can serve one. Hope that makes sense!
