how serious is a solicitors letter about harassment?

hi there

My situation is a little complicated and complex but basically my mum has had my daughters passport since sept when I lgave it my daughter to enrol at college and despite frequent requests by me and my daughter will not it give it back.


I asked for it repeatedly through other family members and she said she would give it back.

Never happened and I need it to check the validity as we are booking a family holiday soon.

So I dropped my daughter at college and called to my mums and asked for it back a couple of fridays ago.

I was very polite but she said she had sent it off somewhere ( not sure ) so I said ok but would she please let me have it when it came back and asked her to stop messing with my daughters stuff and that I also wanted my daughters paper driving liciene so i can add her my to my insurance ...no the drivin instruter said she is not alloed to practie in any car ( a very silly lie )

even tho I know she has it. I was in no way threatening I never even raised my voice and there was a mutual friend there at the time a decorator who heard everything.

My mum refused to give me mine and my daughters property and asked me to leave ....why I said I just want my property which you have no right to hold but she picked up her phone .....I was only in the hall and phoned 999 ( I thought she was phoning my brother or sister) . She said to the police I was there in her flat stomping all over it and would they come out ...I should have waited for the police as i was not doing anything wrong but I had to pick dd4 upso I basically said I really think you are out of order pooped my head round the living room door and said goodbye to the decorator and left absolutely dumbstuck.

picked up dd4 and then I went to see my sister told her what had hppened and said I did not want to get the police involved just want my dd1 passport back...my sister has been asking for it on my behalf as my mium doesnt speak to me much at all ....and my mum keeps saying she will give it to me but has not. So I asked my sister if she would try again but she said only option left is to report it stolen so I did on that same day friday 7th jan

I have not had a visit off the Police concerning either the call out or the reported stolen document.

This morning I got a letter from a solicitors telling me my behaviour is unacceptable and I must not contact their client ( my mum )harass pester or intimidate her in any way in either a private or public place. ??????

If you do not comply our client will seek assistance from the police and the court to obtain orders against you . The court may grant our client ordersfor her protection which prohibit you from using or threatening to use violene against her. A breach will result in your arrest and prosecution. ????

I did not even raise my voice ? I wish I had recorded it

What does this mean ? I work with my sister in a pub and my mum is on the same darts team she stands at the bar ignoring me on other days too ..
this is a joke why has she done this ?

any advise is welcome thankyou if you got this far :(

I would write to the solicitor explaining that you need to get the passport and drivers licence back and if they are not returned you will have no choice but to contact the police and then invoice them for the trouble of gaining replacements - you also have witnesses to the fact that this lady/mother has the documents, give them 14 days to return

then sit back and do not in any way contact any memeber of your family or mention this

Quite long story. My daughter stays at my mums one to two nights a week.

She has internet access there and PC that her dad will only let her use at my mums i is a complicated story.

My mum applied for my CB and then CTC and got awarded them by telling lies.

It has since been resolved and I have both back but my mum is still trying to re apply hence sending the passport off.
She applied for DD4 provisional at her address too.
She told CB that I had reliquished my CB it has took me over ten months to get it back.

She told CTC that DD4 stays at her home 7 /7 another lie.

For goodness sake stop your dd staying there at all.

Your Mum sounds like she has got real problems - sorry - and you don't want your dd to be relying on her for anything, I wouldn't have thought.

I have text messages from my sister and niece saying that my mum said she will give me the passport back dating from september last year.

Are they any use?

Agree with ivykaty write to the solicitors requesting the return of your DD's passport and license within a specified period.

In the meantime I would speak to the police about the missing documents especially since you suspect they are being used fraudulantly (and I assume can prove were used in such a manner previously)

Then can I suggest staying well away from your mum?

I honestly believe that my mum has or is succumbing to mental health issues she is 68 and all this is a way of her trying to gain/ grasp some security ?????

My daughter has always spent a lot of time with her nana ...she is 8 yrs older than dd2 and my mum always gave her that bit of space over the past ten years away from her annying little sisters but this is just abserd now.

I am worred about the implications of the letter ...we are in the same pub btwicea week sometimes more and she just ignores me.
We lay for the same ladies darts team :(

yes.

The solicitor will only have heard what your mother chose to tell him or her.

Suggest you go and see the CAB or a solicitor who will give you an initial appointment free (or check your house insurance, you often have legal cover there). Or just pay for a solicitor if you have the money.

I am going to chase up the report that I made about the passport on Monday.

No problem in written to a solicitor that is acccussing you of harassemtn:

dear Solicitor,

thank you for your letter date of leeter and I would like to ask if you could arrange for your client to return two docuemtns: drivers licence in the name of xxx and passport in the name of xxx.

Thank you for your kind attnetion, I will collect these docuemtns from your offices on the xxx which is 14 days time. This will indeed prevent any further misunderstandings with your clients xxx

Pity you didn't wait around for the police to arrive and they might have made your mum hand over the documents. Agree with other write to the solicitor requesting all your and DD's property back.

I think there's something fishy going on here.
It seems she's telling a lot of lies - why have you let this go on for so long?
I'm unknowledgable about CB issues, but surely they wouldn't just hand it over to your Mother without consulting you?
Why is your Mother applying for your DDs provisional? Surely you/your DD are capable of applying for it yourselves?
Something feels a bit off tbh. Send your DD over and make her get her own passport.

You may have to apply for a new passport for your DD, if you have a crime ref number for the theft that will be enough. (Had similar situation with child in care I work with, passport office said if she wouldn't hand it over to report it stolen and apply for new one)

She sounds quite unwell though, and toxic. Stop engaging.

The letter to the sols needs to be 2 paragraphs:

"I have noted the contents of your letter dated * and deny any wrong doing.

Your client is currently in posession of documents belonging to my D, *, and I would request that they are returned immediately after which I will have no further cause to contact you or your your client.

If they are not returned with 14 days of the date of this letter I will report them as stolen. "

It sounds unlikely that your mum will return the docs and you don't want to enter into any protracted discussions re teh allegations with the solicitor but it is useful to have your response on record should your mum proceed further.

I would be cautious about being alone with your mum. She clearly has no difficulties lying if the CB CTC issues are anything to go by so best to be cautious although don't be overly concerened about the letter. the solicitor is only, albeit somewhat aggressively, pointing out the law.

Will let you know how I get on. I am writing to my mums solicitor and I am chasing up the police report on the stolen passport tomorrow.

Showed the letter to my sister and she is absolutely appalled my sister speaks to my mum on a regular basis and my mum has not mentioned anything to her at all about the police me or the solicitor my sister only knows what i have told her.

Horrible situation my mum told the CB that I had relinquished my claim and subsequently told the ctc that my dd1 lived with her 7/7 an outright lie :( .
I have since got both the CB and CTC back.

Blimey, she sounds like a nutjob!

She's trying to scare you off because she's up to something. I personally would cancel the passport and call the IPS you can get them to call you by filling in this form and explain exactly what has happened, cite the crime number and apply for a new one. I'd do the same with the driving licence. And then I'd stop your daughter going to see her because she doesn't sound very stable to me and who knows what crap she's telling your DD when she visits!

Instead of writing to the solicitor directly I think you should go and get some legal advice yourself. Ideally you need a solicitor to write back denying harassment and stating that if the documents are not returned by a specific date they will take steps to retrieve them. You will also need to tell your solicitor that you are concerned about her mental health

Your daughter is taking driving lessons so therefore she is at least 17. Why doesnt she just get a new passport herself?
