Marital home

When a divorce occurs, the split of the marital home is discussed. What happens if this home is rented?

Briefly -
My DH and I have always lived in a succession of rented accomodation even though we can afford to buy our own house.

I brought no money into the marriage and am now a SAHM having given up my career.

My DH does not want to discuss buying a house and I'm fed up with the constant upheaval and insecurity of renting not to mention schooling issues.

I'm now wondering whether DH is planning a divorce which will enable him to keep his savings for future plans and have no idea where this will leave us with regard to living arrangements/provisions.

Anyone with similar experiences or advice?

The marital home is just one of the assets considered in a divorce. If you rent, your home clearly isn't an asset as you don't own any of it. Your DH's savings, however, are an asset and will form part of the settlement. It is likely that you will be entitled to a slice of his savings.

Thanks for replying.

That's reassuring to know as I won't have anything for a deposit until I go back to work.
This is impossible anyway due to the age of my children - even subsidised childcare costs are way over my salary.
