New job but still on mat leave

I've just found out I have a new job but I still have a month left of mat leave (which my new employer is aware of) I'm wondering if I hand my notice in but start at the new placd earlier than the official end of my mat leave, would my old employer still pay me smp. I also have holidays so I assume they'll pay for those?

As soon as you start the new job your entitlement to smp ends. I don't think you can even do anything with keeping in touch days because you won't be keeping in touch as it's new job. SMP is paid while you are on maternity leave. You cannot be on maternity leave and working at the new place. You're either on leave or at work.

You old employer should pay your accrued holiday.

You can't be on mat leave and working. If you start another job your SMP will have to stop. They should pay you for your holiday. Did you have any enhanced maternity pay from your current job? What is your notice period?

I think your smp stops when you start working again, even if for a different employer.

Has it just been standard SMP you've been entitled to?

If your current/old employer has been paying you anything extra, they may well want that back. That happened to me when I decided not to go back to the same job after maternity leave with DS1.

Thanks all that is what I though. No enhanced just standard pay so there's no issues there.

I only have a month left of mat leave so it's worked quite well. If I hand my notice in tomorrow say, that would bring me up to the last week of my mat leave anyway and there's only 3 days I wouldn't get paid which we can cope with as I'll have holiday pay.
