Employing a job share

If 2 people apply for a job with a view to becoming job share partners and one is suitable and the other not, can you employ one and not the other?

Are employers obliged to shortlist job share applicants if they meet the person spec?

Thanks for any advice

You can employ whoever you like as long as you don't discriminate, and are not legally obliged to short list anyone regardless of whether they meet the criteria.

Presumably if you employ half a job share it would involve a recruitment campaign to find an alternative partner, so if you are not keen on one partner it doesn't seem to make a lot of sense to recruit the other one unless there is a shortage of full time candidates.
