Maternity leave - Redundancy

DalidaPP · 30/09/2009 15:31

My employer has announced that the number roles in my area will be reduced, my maternity leave will start on the 1st Nov. I have read that my employer could offer me a position in similar conditions that the current one as part of my rights. If they offer me a position and I accept it. Does it mean that they will keep that offer for 1 year and I will have the role once my ML finish? or Do i have to end my ML earlier?

Thanks

If your position is redundant while you are on maternity leave, your employer must offer you something else suitable if there is anything available. The new job must start immediately the old one finishes but they can't insist you come back from maternity leave early, no.

If you accept the role your maternity leave will continue for as long as you want it to, that is you will still have the right to 52 weeks. The legal assumption is that a woman will take 52 weeks leave and if she wishes to return early she must give eight weeks notice of ealry return. So no change to your maternity leave entitlement.
