can anyone (esp flowerbeanbag!!) help me work out if my holday entitlement must include public holidays?

I used to work part time and the days that were bank holidays that fell on the days that I worked had to be taken as part of my annual leave.

What your work is saying is that your total holiday entitlement is 112 hours a year, but you don't get bank holidays on top of that. As a part timer you are entitled to the exact same holiday entitlment as a full timer, including bank holidays, but all in proportion to your hours. So if full timers are entitled to 8 paid bank holidays, then someone working, say, 3 days a week would get 5 of those, if that makes sense.

Your work are saying that if you want to take bank holidays off, it comes out of the 112 hours total, it's not given on top. What the arrangements are for if you want to work the time I don't know, that's a company thing. If you work the time you will keep your holiday for another time.

The crucial thing is to make sure that you are getting the same entitlement as a full timer on a pro rata basis. Do you know what the full time holiday entitlement is where you are?

The bank holidays are part of your entitlement so it doesn't matter whether you take them off or not; you'll still have the same number of holidays per year. Since they're paying you overtime (they don't have to!) you might as well take advantage of that and continue to work bank holidays.

what is confusing me is that I normally work the BH and get paid time again eg.double time

so if I worked it would I lose a days holiday but just get double time?

its so confusing

If you work a bank holiday you wouldn't lose any holiday. If you don't work it, the time off comes out of the 112 hours holiday you get.

thanks, just to clarify, if I work a BH I still have 112 hours holiday, if I don't work it I have 112 hours minus the BH day?

Yes.

Don't think of bank holidays as holidays - they're normal working days as far as your contract of employment goes.

You're confusing yourself by thinking bank holidays are some kind of free holiday - they aren't.

You can take your holidays any day you like, but if you take a holiday on a bank holiday you'll miss out on getting double pay for that day (because you didn't work.)

I think my work is saying if we get double time for working a BH then we lose a days holiday off the 112 hours? does this sound legal?

i'm not sure about taking annual leave on a public holiday but in the NHS we loose 7.5hrs annual leave if we are sick on a public holiday

ssd it sounds as though you only get the minimum holiday allowed so they can't reduce it no. But based on your OP that's not what they are saying, they are just saying that if you choose to take those days off, it comes out of your holiday entitlement.
