Not usually, but it depends on his contract. Is it a permanent contract with specific hours, or some kind of more casual contract where hours may vary according to work available or similar? Also, how long has he been working there?

Have a read here about temporary lay-off and short time working to see about when this is paid and what to do.

If it is in his contract then yes they can. We have a "lay off" clause in ours. It is meant to help the business in times of financial trouble and more importantly help avoid redundancies.

For example - if our business has no work for 3 weeks, but knows/hopes/thinks there is work coming in soon we can "lay off" staff without pay. Saves us money and ensures employees have a job to come back to (well hopefully).

For us redundancy would be a very last resort, lay offs, short time working etc are all tools to keep everyone in some sort of work, even if it means less wages in the short term.

He is in the building industry - which is currently on its a**e. He is employed (not self employed) and has been there for five years. Some of the employees have work and about 10 are affected this week whilst all the others are in work this week.

What kind of contract does he have? it is possible the right to do this is written in and was previously agreed, as in callme's example.

Then yes there is a case there as there is a basic employment right to have written terms and conditions.

sounds just like my dh!was told yesterday hes no longer employed as of next week but they may want him occasionally as self employed(cheers).like your dh no contract etc.weve just moved to more expensive house with more expensive bills.am pooping myself.

Agree in that case they can't do it, and as he is entitled to a statement of some basic contractual terms, if he has never been given this that's against the law as well.

Is he in a union?

He is not in the union, but he has a meeting with an employment specialist tomorrow at the citizens advise.

Well he did not get much out of the meeting really, seems they can lay him off with no pay. He was told that he was not getting his full holiday entitlement though.
