parental leave

can any tell me how much notice an employer has to give if refusing parentalal leave.

i have been able to find out i have to apply 21 days in advance but if its refused do they need to let me know so many days before the leave was due to start

Hi, how much leave are you requesting to take? Have you applied for it already?

sorry dont know - asking for a friend who didnt realise that there were deadlines for applying - so im not sure if shes already applied for the leave yet - shes taking it sometime next year. dont want to give her false hope if its refused

The parental leave regulations give power to employers and employees to enter into agreements which provide for a certain flexibility, by means of a collective agreement or a workforce agreement which must be incorporated into the individual contract of employment - check with your friend to see if this kind of agreement exists in his/her workplace.....if not then Sch 2 of the Regs will apply and this is the 21 days notice that you talk about...which the employee must give to the employer. I do not think that there is a time limit as to when the employer must get back although common sense says that the employer should get back asap.

I take it your friend falls into all the other criteria, ie length of service, parental responsibility etc?
