Applying for prootion while on maternity leave

I have just found out that a colleague will be leaving in September. She is on a similar level to me but with slightly more responsibilities (+ slightly more pay!).

Her extra responsibilities are likely to be internally advertised in 6-8 weeks , by which time I will be on maternity leave.

I have done her role before in a previous job (currently in a less well paid job to get more variety of experience I wasn't offered by previous employer).

Anyway, my questions are should I show an interest in the job to my manager (before it has been officially advertised) and as I will off for 9 months can this go against me? I think the answer is no to the 2nd question due to discrmination but can't find any info anywhere.

I think you will find that your employer is not allowed to discriminate against you because you are on maternity leave.

Tell them you're interested and keep in touch with the office for when the job comes up and then apply for it.

Yes, make it clear that you are interested in career progression and that you will be returning to work after leave and you would love to be considered if a suitable role comes up. Put it in writing and keep a copy and log any conversation/response.

They should then let you know if it is advertised so you can apply.

There was a case (Visa International Service v Paul 2004) whereby a female successfully claimed constructive dismissal. She was not told of a vacancy whilst she was on maternity leave, she was suitably qualified and it would have been a promotion. They were found to have breached the implied duty of trust and confidence in the contract of employment by not telling her about it.

So, it can't go against you if you are off for maternity leave, if it does, it would be sex discrimination.

you should make sure that HR email all internal adverts to you during your mat period. if they don't arrive pester them until they do.
