Annual leave and Bank Holidays.

Two apologies first off - 1) I expect this has been done before so sorry for repeating it 2) I'm not sure I'm going to express my self overly clearly but hope I make some sense!

I work two days a week. 12.5 hours. Monday & Tuesday. So am entitled to 11.2 days/70 hours annual leave.

Bank holidays have to come out of our leave. Entitlement runs from April to April.

So 2016/2017 leave I've worked out I have 30 hours that have to be taken due to bank holidays.

I sort of don't have an issue with this, until some of the other people at work don't work days that bank holidays fall on so get all of their leave to choose from.

I've offered to go in and work on bank holidays, this was turned down. I can and do where possible cover other holidays/sickness and can then transfer the days holiday if that makes sense.

I'm guessing it's just bad luck I work on one of the most affected days and there isn't anything I can do - but just thought I would ask and double check.

It all depends on how your company calculate the holiday.

Where I work holiday accrual and bank holidays are separate. So one of my team works 4 days a week, so she gets the 25 days holiday pro rata, but will also get paid for any bank holidays that fall on her normal working days.

If as your company do, they add the bank holidays to your holiday accrual. I expect you get the 28 days minimum including bank holidays pro rata. Which I do not think is the fairest way to do it. It is not fair that they do it that way and most of your holiday gets taken up with Bank Holidays.

I would suggest is you calculate your holiday pro rata, and then the bank holiday pro rata. Eg 20 days holidays pro rata on 2 days is 8 days holidays, then the 8 days B/H is 3 days. Work out how many B/h are going to be on your working days over the year. If it is more than 3, go to HR or management and show that you are being unfairly treated and that you are loosing out on holiday as more Bank Holidays fall on your normal working days than the pro rata Bank Holidays allow for.

Does that make sense? It may not make any difference, but worth a try.

Thank you - it does make sense. I'll do some more workings out and go back to management and although I don't think it will make any difference I can say I tried!

What you've described is normal - you are getting half your working week off when a bank holiday falls on a Monday, most people get 20% and people who work the second half of the week get a lot less benefit. That's why pro rats bank holidays were introduced so it's fair.

The important thing is that you get the same amount of paid time off on a pro rata basis as full timers.

If the fact that more of your working days fall on bank holidays means you don't get to choose as high a proportion of your paid holiday as others is unfortunate. But the only ways round that are working bank holidays (which you can't do) or taking unpaid leave instead, leaving more paid annual leave to use at another time.

The only other way of giving you more holiday you can choose would be to give you additional paid holiday days, which of course wouldn't be fair on either full time or other part time staff as you'd end up with more holiday than anyone else.

I did sort of know it really was just bad luck on my part. Just wanted it confirmed. Which you have all very nicely done.

I'll suck it up and just enjoy the time I have.
