can anyone help me with holiday entitlement issue?

hi, I've been told I am to get 16 days holiday entitlement, which is 80 hours a year. I work 20 hours per week. have been told will get double time for bank hols worked, they arent mentioned in hol entitlement. if I work a bank holiday its totally dependant on managers mood doing the rota, no guarantees of getting it.

is this legal? I understand the hol entitlement is now 5.6 weeks per yr pro rata, surely this would be more then?

I think the bank holidays complicate things a bit. I can't give you a definite answer because my 'leave calculator' program I use for my staff includes bank holidays but I think that on the assumption you would be due to work every bank holiday but had it off (hope that makes sense) then your leave allocation is right

our bank holidays don't come into annual leave. we get bank holidays off in addition to our annual leave. if I work a bank holiday I either get paid double time or two days of in lieu at a time when I want them off.

Bank holidays are a red herring - minimum entitlement is indeed 5.6 weeks, so based on your 20hr working week, you are entitled to 112 hrs paid hols.

The minimum leave you are entitled to is 5.6weeks worth so in your case 112 hours. Bank holiday hours can be included in that figure or added onto it depending on the employer.

pay is a separate issue tbh but you should make sure you are getting the statutory minimum leave hours

surely if bank holidays are included in that then this should be mentioned in my new contract?
it just says hol entitlement is 16 days/80 hours? for working a 2o hr week.

You will need to speak to them to clarify but they are not giving you the statutory minimum holiday entitlement

Are they not talking about 16 whole days ie 7 or7.5 hour days which would be right number of hours. I'm taking it you work shorter days

You are entitled to 5.6 weeks annual leave in total. Your employers still appear to be applying the old 4 weeks entitlement.

20x5.6=112 hrs per year.

yes they seem to be following the old 4 weeks entitlement, I thought that.

they mean 16 days at 5 hours per day = 80 hrs total.
