Change of Contract

I'm wondering if anyone would advise on whether it is legal for my employer to change the terms of my contract with regard to the days of the week I work without my agreement.

I am currently obliged to work a 36 hour week Monday to Friday. It is proposed that this will change to 36 hours per week Monday to Sunday on the basis that I will be required to work at weekends (but not every week).

The exact wording of my contract is:

Hours of Work
'Your normal working wee is one of 36 hours which will be from Monday to Friday. This may be varied subject to the needs of the service.'

I'm not disputing that my contract can be changed - what I want to know is if it can be altered unilaterally without my agreement.

I would be really grateful for any advice.

With notice , I think they can. How long have you been there?

There has been no negotiation or consultation.

Isn't the wording too vague to apply to the days of the week - it is under the heading of Hours of Work

No. A change to your terms and conditions requires your consent. If there are good business reasons for the change and they consult fully, there are ways to force it through without your consent, but they can't just give you notice in that way.

Thank you Flowery - that is what I thought and what I've managed to glean from the internet.

But our HR department has told me that 'the employer has the right to dictate the terms of the contract' Confused

Sorry to jump on the post. Would love to see what people think. Posted a thread myself earlier in the week. I have to change my hours off 22 a week over three days to 22 over four days. I will be worse off for it as if I could get childcare which I can't I would have to pay extra for it. Plus the extra petrol for my 30 mile round trip commute. I am going to go to CAB for advice
