If I resign, will I still be entitled to maternity allowance?

Hello, if anyone can help me with this I would be so grateful as I'm getting desperate and
no one seems to be able to help. I am having a lot of trouble with work since I told them Iam pregnant and I want to resign, I can't stay there anymore so I know I won't qualify for SMP but I'm wondering if I can still get full maternity allowance if I resign? I have looked on the government website and it says I should be able to but I don't want to resign until I'm sure. I am only 17 weeks pregnant at the moment but I will have been employed for over 26 weeks of the 66 and earn around 1200 per month.
Thank you in advance if anyone has any information

Hi Teri, sorry you're having a tough time.

It sounds like you might according to the NHS website www.nhs.uk/chq/Pages/2293.aspx?CategoryID=54#close

From the site: you're entitled to Maternity Allowance if you’ve been employed or self-employed for at least 26 weeks in the 66 weeks before you’re due to give birth or you earned at least £30 a week on average over any 13-week period during the 66 weeks, or you’ve recently stopped working.

Payments would be via the jobcentre, so give them a ring to check your status (0345 608 8610)


What maternity pay would you get if you stay at work? If it's a reasonable amount more I would really, really recommend you stick it out. Is there anything specific happening that you want to talk about?

ps That web page was correct as of April 2013 - I don't know if things have changed since then

why can you not stay at work? Are you in a union? If your employer is acting in a way that is forcing you to resign this could be constructive dismissal. you should seek advice. x

Can you hold out until you are 26 weeks?
If you do and then leave, your Employer HAS to still pay you your SMP.
