I came back to work in April where my place of employment was Wimbledon (approx 15min drive from my house) which is a site office from our main area office at Waterloo. Anyway our contractor lost the contract and we have now been moved back to Waterloo on a permenant basis. I work for the railway and am entitled to a 40% discount on my season ticket, basically the company lends me the travel money and I pay back 60% monthly for 10months. This would be ok except I have returned part time and am only in the office 2 days per week, I have requested the loan so I don't have to pay the silly amount for travelling to Waterloo (£30 per week for 2 days!!!) but have been refused because I cannot give them proof of purchase 6monthly I can only do it 3 monthly (the train company will not issue the ticket I need any further in advance).

I feel quite discriminated against because if I was full time and moved into London I would be a lot better of pro-rata than being part time. Does anyone think I can take this further as it just seems really wrong to me.

Ok this is from one of my colleagues (TU official)

"Hi Carl, The first thing is to check the contract of employment and find out what it says in relation to the right to return.

The legal position is that a woman is entitled to return to the job she was employed before her absence on no less favourable terms and conditions.

If you want to borrow my law book let me know."

I think they may say that you are doing the same job just different hours.....
Do you feel up to arguing your POV with them? You really need someone with some "clout" to put your case are you in a TU if not the CAB may be able to help.

Is a season ticket good valeu for two days a week? Would it not be cheaper to buy a ticket every day?

Would a six-month ticket be available if you were travelling every day? If not, then you have no case as your position would be exactly the same as a full-time employee. If it is, then you are beign treated less favourably, but you still have a weak case as a season ticket loan is a benefit, not a right.

Where do you live? We are in zone 3, South London and my DH only pays £12.50 per week for a full time train pass to Charing Cross via Waterloo.

This might be an odd thign to say, but have you asked the train company to confirm that they won't do 6 months in writing and given this to your employer and asked them to make a seemingly reasonable exception (bit odd if they are the same train co. though!)
