Change in days

I currently work 3 days a week when I went from full time to part time my boss let me pick my days. I am due to go on maternity leave againsoon and the girl who covered me last time (keep up if you can!) replaced me as a full time employee but after returning from her own maternity leave went part time and was told her days had to be ones I don't work. She has decided that while I'm on leave she will change her days to mine and I will have to fit in with her on return. This will not fit in with my childcare arrangements etc. Does anyone know if my employer can swap my days while I'm on leave or not. A bit concerned as you can imagine and annoyed. Sorry so long but a bit complex!

I'm not sure there is any specific legislation that covers this, but it would be a change in your contract, so theoretically if it happened you could resign and claim constructive dismissal. This might get you compensation, but it would leave you without a job.

Has your replacement decided that you will have to fit in with her, or your employer? I suggest you talk to your employer at the first opportunity and try to negotiate to keep your days.

surely she can't decide by herself, do you have a contract stating which days you work? I would tell her that upon returning you will be doing the same days as before, that would get my goat up Angry

Your employer cannot change the terms of your contract without consultation.

Thanks for your replies. Have just given my employer a letter stating when I will be returning and that I will be working the same days as now. This is the first time the days I work has been written down any where - prob with working for a relaxed small firm things aren't done totally correctly! Hopefully that should sort the issue out she's just a selfish person!
