Removing dd from current school due to bullying and intending to register as home ed till the end of term.

Dd has a school offer in a different borough for September. Someone on another thread has said that in their LA if you register as home ed even for a short period they remove the place you are moving to.

Legally could I appeal removal of the place if they did?
Also with the offer being in another council should I be ok anyway?

Can't answer your main question, but there is one thing on your wording that worries me, so just to be on the safe side:

You keep talking about 'offer' . It is more of 'I have accepted a school place in a different borough for September' isn't it?

Hope the summer and the move go well for your DD.

Any issue should be avoided by good communication. So as well as communicating with your current school i would communicate with the September school and the other council. I would initially make phone calls and then follow up by email.

Is the school that you are moving to an academy? If they have space in September, do they definitely not have space now? An earlier move might help your daughter settle and reduce anxiety about what lies ahead. London schools deal with mid term transfers frequently.

They cannot remove an offer just because you home ed. That is illegal. You could appeal if that happened and I would expect you to win.

They can remove an offer if you don't take it up within a reasonable period of time. However, if the offer is for September you won't have any problems on that front.

As long as you have accepted the offer you should not have any problems.

Thanks all
Sorry yes she has a definate offer. The school does not start until the next year group up so she cannot start earlier.

Thanks Prh I had the letter all ready to go but someone posted this on another thread and it scared me!

'The LA here automatically withdraws ANY & ALL school place if a parent elects to home educate, even if it is specified for a short period. Home education is supposed to be a philosophical decision not a way of avoiding school for a few weeks or people would claim home ed for their fortnight in Florida during term time. It may be different in your authority but Please check! I've had more than one parent get trapped by this and end up with no school place to go to.

No the current school cannot stop your daughter moving to the new school.

My DD is being home educated for last term of Y6 and she has an offer to start at a school in September. There's never been any question about the place not being taken up or of it being taken away. We were clear in our intentions and all has gone smoothly and DD attends the induction day on Thursday.
