Goods not received - what do I do next?

I bought a dress from eBay to use as a costume in our Christmas amdram production.

The seller had 100% feedback, but it was only for 1 item - this was her 2nd ever sale.

Anyway, I was buying tons of other stuff on ebay for the show when it struck me that I hadn't received the dress.

I emailed to check it had been posted and got a rather snippy reply, saying that she'd posted lots of stuff and it's all been received, and that she had proof of postage that it had been sent.

I replied saying that I'd received everything else I'd purchased, so as she had proof of postage, was it her that needed to take it up with her post office or me with mine (I've never had something not get delivered before, so wasn't sure of the process)?

She replied saying she'd send me a copy of the proof of postage if I wanted. I said yes please.

That was 27th November. I still haven't received this proof of postage.

Do I contact her again or do I open a dispute?

The item was won on the 18th November, I'm beginning to suspect I've been done - if I do contact her again, do you think this is a reasonable response?:-

Dear XXX,

Since I contacted you on 27th November, I have not received the copy proof of postage you said you would send me.

As all my other expected post has been delivered without issue and on time, if I do not hear from you by Wednesday 10th December I will have no alternative but to open a dispute with you and start proceedings with Paypal to reclaim my money.

Is it too harsh?

Any advice you can give will be v. gratefully accepted!

Open a dispute you can't claim from your post office anyway she would have to claim from hers so proof no good to you.
She should offer a refund and has had more than enough chance to resolve this.

but if you didn't pay for recorded delivery you won't get your money back so what's the point of a dispute.

Lauriefairycake It is up to the seller to send items by trackable means.

Lovecat Dont even bother to give the seller anymore time, just open a dispute and claim your moneyback

Go through pay-pal, if the seller has proof of postage she should put in a claim through royal mail.

Nope, I can paste an old email from paypal which says you need to have it in writing from the seller (or in their conditions in the auction) that they will send it recorded delivery which they charge you for.

And yes it is up to the seller to claim from the post office if they've sent it 'proof of posting', it is pointless them sending you the proof of posting receipt.

Only once Royal Mail has paid back the seller once they have investigated it - can take months.

Thanks all, I thought it was a little that she was going to send me proof of postage to chase it up at my end, but then I've never had anything go astray before (suppose I've been lucky the last 42 years...) so had no idea.

She didn't offer recorded delivery.

I will go and open a dispute (ooer, not good at confrontation!).

make sure you escalate it to a claim too!
