A radio sold in May-buyer says it has become faulty and wants a replacement. What do I do?

Help-have had an E-Mail from a buyer who bought a new radio from me on 1st May 2007. It has now stopped playing so after contacting the manufacturer she has been told that I have to provide a replacement! Obviously, I no longer have the receipt and I sold it unused and in good faith.

Where do I stand and what shall I put in the reply E-Mail?

If you didn't offer a guarentee it's not your problem. If it was broken on arrival yes but not a few months down the line.

Depends - did you sell it as "Under warranty"?

The truth of the matter, of course, is that they've already left you feedback and so don't really have any recourse. The only thing they could do is sue you, and they're hardly likely to do that for the sake of 50 quid's worth of radio.

I would politely say that the item was sold new, but still "as is", and so they'll need to work with the manufacturer to claim on any warranty.

I would ignore her! It's not your responsibility now, so far down the line. If it worked and she was happy when it was received then I can't see how it could be your fault that it is now not working, for all you/ebay/manufacturer know, she has dropped it, whacked it, god knows what!

I have the same radio-ended up with 2 so sold one. It does say to record the date of purchase and retailer and retain with proof of purchase but I wasn't going to send her my Credit Card receipt so shredded it once I had feedback. I just sold it unopened so didn't even get the warranty card out of the box.

It doesn't matter if anyone's left feedback...she could claim from you if it was under 45 days from transaction. As it isn't within that time frame she cannot enforce her request.
It is not something you can help with unless you have a warranty for it to pass on etc. but I would apologise and say that it isn't really anything you can help with. She might have done something to it, exactly.

She probably didn't tell the manufacturer that she bought it "as new" on Ebay - they will be thinking she got it from a shop. YOu have no obligation towards her.
