AHRGGGH! am i right in opening a paypal dispute???

i won this

and its turned up without a raincover,

It had the back panel to the raincover but the main bit wasn't there.

I emailed the guy notifying him of his mistake and he says

'raincover is not included in this, no where does it state that - its an optional extra'

but it does say raincover! At the top where it says features ... it says ...

Adjustable Back Rest, Adjustable Handles, Adjustable Leg Rest, Five-point Harness, Hood, Lockable Swivel Wheels, Rain Cover, Shopping Basket, Travel System Compatible, Mug Guards

see raincover!!

now he send me the mudguards, the adjustable handle ect .. why not the raincover!!

And no where in the auction does it say 'raincover NOT included'

am i right in opening a dispute?

It does say raincover.

I would copy the entry and send him a copy stating that it clearly says raincover, and telling him that you intend to start a dispute unless he sends it to you.

i'm guessing he perhaps copied a) either someone else's wording, or b) the description off the box and didn't register the 'raincover' word.

but when listing you click the 'features' so he mustve clicked raincover.

If thats the price you paid for it then he should either refund the cost of a raincover or send you a raincover as described

Thats what Ive asked him to do.

I hope he does, im bloody skint so cant go to mothercare to buy one! & it was pissing down today.

I had to put a stroller raincover over the front seat and DS2 had to sit in the back and wear his waterproofs!

QUICKUPDATE,

when I posted this i had emailed him about 4 days previous about it, and then 2 days after that opened a dispute.

He has now replied Via Paypal dispute saying Raincover isnt included.

Should I esculate it to a Claim?

I dont think he is going to offer a part refund himself,

but i do believe I am in the right and i also believe his auction completely 'made out' that a raincover was included.

My friend also ordered one of the buggies expecting a raincover and she hasnt got one either - so its not just me interpreting it wrong IYKWIM.

Does anyone know how long it takes for paypal to decide?

I have had to buy a raincover seperatly yesterday because it keeps raining, and I really couldnt afford to but had no choice, so I want to be reimbursed by him.

yes, escalate to a claim.

You are right, there is no way they can not rule in your favour. You may need to return it for a refund tho - not sure how a partial refund works with paypal.

Paypal don't take too long - my friend has just waited about 2 weeks but that was because of further complications

I cant return the whole buggy, I need it,

it said on there would you accpet a partail refund to stop the claim, and i saiddd yes and entered £23 in the box (what I had to pay yesterday to get one)
