Goods not received - advice needed please

Hi

I had my first experience of ebay at the end of april. I won an item and sent a cheque for the £3.90 by first class the same day. I sent an email to the bloke telling him this and all was ok. On the 3rd of May i noticed he had cashed my cheque but no good arrived. I have sent 3 emails asking when he will be despacthing my order but have had no reply. This morning i sent him an email saying that if i didnt hear from him shortly i would be left with no alternative but to involve ebay.

Remarkably i have received an invoice from him saying that payment is now well over due and if he doesn't receive payment within 3 days he will raise a dispute with ebay.

I have replied with thats fine by me as i have my bank statement as proof plus all the copies of emails sent to him but not responded to. Ive told him that if i dont hear from him to say he has despatched the goods or a refund then i will raise a dispute myself.

Im sorry this is so long winded but, my question is, should i go ahead and raise a dispute first or wait for him to try discredit me. I have 100% feedback at the minute, all for superfast payment. I dont want him to spoil that

Gosh! I am fuming!!

Do you think so? The cheeky so and so! I know its only £3.90 but its the principle of it.

I don't know if I'd report him straight away, can you check how much/how often he sells.
I he's selling a lot your cheque might have gone unnoticed in a pile of others. I've been guilty of that before

I'd start the item not received dispute.
he's had plenty of time to send and/or reply to your emails.

Update.

Ive just had 2 emails. one saying the goods were sent on the 25th of april. So ive asked for proof of psotage.

The second, obviously from someone else saying they have no record of my payment, asking for cheque number, account number and if it was in a different name. Ive sent my reply but just had a failure notice saying that my email has not been delivered as this email address is no longer active!! Thats within a space of 5 minutes.

I smell fish!!!
