Where do I stand. Signed for delivery, damaged package and item missing

Can anyone advise?
I won an auction and the seller posted the item, 1st class signed for. The delivery was attempted yesterday, but I was at work. I went to the sorting office this morning before work (in a rush), collected the package and signed for it. I didn't notice until I got to work that the packing was in fact damaged (there was a tear in it, where the seller hadn't taped the edge) and the contents was missing. Just been back to the sorting office to inquire what to do and they said they aren't responsible as I had signed for the item. Yes I did sign for it, however, I didn't realise that I also needed to check it had contents as well! It was a small envelope containing a piece of jewellery. I've been in touch with the seller and am waiting to hear back. Should I take this up with ebay, paypal or royal mail? Bit miffed as £28 out of pocket. :-(

You'll easily win a not as described case (go to Ebay resolution centre & follow instructions). It doesn't matter that you didn't notice the damage /missing bits before you signed.

Yes, open an SNAD case with eBay and include photos. If the seller tries to tell you you must take it up with Royal Mail. Or wait until they are compensated by RM, ignore them and press on with escalating the eBay case.

You cannot open the envelope to check the contents before you have signed for it.
It was very likely stolen in transit which is why the PO staff didnt want to hear your complaint. Escalate it, the seller can claim.

We've had no end of stuff nicked from slashed envelopes. I complain every time to the PO as they need to know their staff are helping themselves.
