What would you do 1st difficult seller.

Hi girls,after a really decent start to my de-cluttering I have hit a real problem with a buyer my first since I started using e-bay.
I bid and won a mannequin for my displays and it arrived this morning,I must admit it was packaged OK and arrived within the given dates,once unpacked I have found it is missing a vital part (the pole that ajusts the height) without it the item is useless to be honest,I had also been overcharged £4.00 on postage,and whilst I was happy to pay the amount quoted I do not expect to be ripped off when I know the price of the postage through using the same courior myself on a regular basis,he tried to tell me that he pays extra for insurance but it is included up to £50.00 in the postage cost.
When answering the question re missing part he states "really" oh dear !! so I feel I am going to have problems here,any ideas which way to go now its a shame as its just what I needed at the minute it would have helped my sales no end with a decent display.(sorry so long and drawnout post)

Tell him you'll be reporting the item as not as described, unless he finds and sends the missing part. eBay do tend to favour the buyer and as it's clearly missing I don't see how he can argue. If he does, open a case against him and eBay will most likely find in your favour if it is exactly as you have described.

I am going to give him the benefit of the doubt and give him until tea time to-night to respond to my email,but I have a feeling he will ignore I have just gone through all his "feedback given" and his attitude is awful so I am not expecting an easy ride with this,with this being a SNAD case am I responsible for the return postal cost as it was quite expensive to post and I feel with it being the seller's error he should stand the return cost,I've also looked at his P&P feedback and 40% of his buyers comment on the high postage but I realise ebay won't get involved with a dispute re P&P,I am just annoyed about it.

Can you source or make a replacement pole, was the pole promised in original listing or implied that mannequin stood fine without it? That is the only problem I would find with this purchase & want fixed.

Different sized poles for different makes (I had a look on line) really the item is not fit for purpose I would like him to find original one and post it off to me but feel he won't comply or I would have heard back from him by now I think,I know if one of my buyers wasn't happy I would respond asap,he is not a business seller so is not closed over the week-end but will give him until later to-day then open a case for SNAD.Pole was shown in listing and stated as ajustable.

Is he a business? If so he should stump up the cost of the return. just get the case opened - why wait? And make sure you neg too, and leave low stars.

Auburn I have opened a case as no response from 2nd email giving him the opportunity to find part and post on to me,I'm not sure if he is a business seller his address on the parcel delivered is different to the address on his pay-pal details so not sure if one is a business address or not,I know its a small amount and he is probably miffed that I got item for such a good price but thats the name of the game I was just lucky.I bet I will hear something to-day now I've opened a case as he has 100% feedback even though his P&P charges have been quoted as being expensive,so no one is negging him are they ?

Well I knew he was going to an a--e didn't I ? he has replied to say I should have given him more time to find the missing part before I opened a case and do I realise that he has just moved house 2 mths ago and his stock is scattered everywhere ? how is that my problem I ask ? surely if you are selling something you would make sure all the bleddin parts where there or am I on a different planet ? also told him I am not letting go about the complaint about the excessive postage but he is staying silent on that so will have to wait and see what happen's,he has however just found the pole and has asked me what I want him to do with it,well I could tell him in 5 easy words but I need it for my displays so have told him to send it to me,shall I keep the case open until item arrives I think that is the way to do it ?

yes do keep the case open. And yep - his house moving woes are most certainly not your problem! Have you negged him yet?

current I was going to wait and see if the missing part turned up before the timing on the case runs out before I negged him,I've just had from him the saga of me knowing the p&p costs when I bid and won,and whilst yes I did know the cost and agreed to them, as I explained to him I was not aware how much it weighed and what size the box was (all make a difference to postal charges)and that it was against ebay rules to profit such a lot from P&P charges and charging buyers insurance,when ever I have had cheaper postage over £1.00 I have always refunded via pay-pal process maybe I am just too honest !! I shall just hope the part arrives as he has said he will find it and post on his way home from work this pm.

I agree with you completely about p&p. How long until the case times out - is it 30 days? I know you can escalate within 8?

current Yes its 30 days but I can escalate it next Tuesday after 8 days will just have to see if the pole arrives by then,I am not holding out too much hope really but he may surprise me you never know,I am certainly not going to let go of the postage issue I will rate his "stars" low for P&P when the process is finished,the annoying thing is I have quite a few things I want to photograph and the mannequin is useless to me at the moment.
