I want a partial refund, how much should I ask for?

I bought a pair of shoes on eBay for £16 plus £5.50 p&p.

The shoes were listed as "in very good condition only used as a best shoes"

I received the shoes yesterday and was not happy to find that there are scuffs on the toe/front of the shoes, one of the shoes has paint splashes on the side (although it will scrub/scrape off as there was a small amount on the other shoe that I managed to clean off)
There are also three deep scratches on the front of one of the shoes and both have creases and scuffing from where the shoe/toes would bend when walking.

The shoes are basically in an acceptable but well worn condition, definitely not the very good condition advertised, also none of these marks were mentioned in the listing or shown in the pictures.

All that being said the shoes are a well made brand and all of these issues are cosmetic and the shoes still look to have a lot of wear in them.
I specifically wanted this brand of shoes because I know the are hard wearing.

I do not want to return the shoes but I do think they are not as advertised and would like a partial refund from the seller.

I sent her a message yesterday to tell her about the condition the shoes arrived in and how disappointed I was, but she has not yet responded.

Is it acceptable for me to ask for a partial refund?
And how much should I ask for?

I think if you are not happy you should return them. If you still want them, that asking for a partial refund is a bit cheeky.

I have given partial refunds quite a bit as it seems a lot less hassle for me than return/refund etc etc - what would you have paid for them if they'd been listed as 'well worn' or some such - would you have gone to a tenner for example? then ask for the difference between what you would have paid and what you did.

I know that.
However, the shoes were advertised as being in very good condition, they are not, I would not have paid that much for the shoes had I known the actual condition but I would have still bought them for a price that realistically reflected the condition.

Surely this is a standard case of an item being not as described which is why I think I am entitled to request a partial refund.

and I probably would have only bid £10, but I wasn't sure if that was too much to ask for.

Give it a try - or if you think it's too much - say £12?

You have to open a case I think as a 'not as described' and see what they say - I'd go for a bigger number first as you then have some room for haggling!

If the seller doesn't get back to you quickly then you could open a case as not as described which might make the seller respond. The seller does not have to agree to a partial refund but may want to instead of getting the shoes back for a full refund. If the issues were not in the description then the seller is in the wrong. If the seller doesn't reply then ebay will refund you anyway if you have opened a case. I think you probably need to go through a case to sort this one out.
