What would you have done in this situation?

I bought an item on ebay and paid for 2nd class postage. Four days later I received a message from the seller apologising that she's been in hospital unexpectedly and hasn't sent out the item: her friend will do it tomorrow 1st class recorded at no extra charge. Two day later a parcel arrived, but it's not my item. It's gorgeous though, and clearly worth a bit. A search on ebay reveals that it's another item sold by the seller on the same day as mine.
I contacted the seller who apologised profusely (still in hospital) contacts the other buyer who has my item, and asks me to post on the parcel I have 1st class recorded, saying she'll pay me back postage plus a fiver for inconvenience.

Not specifying the items but they are items of clothing/footwear, both between 50-100. So, would you have sent on the item, having already paid out for your purchase?

So as not to drip feed: I did send it on. The buyer did send me the postage plus a fiver. So now the other party has two lovely items, and is refusing to forward mine saying that they don't have to because it was unsolicited mail. I know that the seller will have to refund me, so it's not that. It's more that I'm sad for her that she's losing out on the money and for myself that i may never find this item again.

Can appropriate feedback be left? What do Ebay say?

It would have been more laborious, but perhaps a better solution would have been for the seller to have both items back, so that they would go out together to the correct buyer, and the unscrupulous one couldn't have pulled a fast one.

You did the right thing. Odds are it will come up on Ebay again. Shame on the prat who wouldn't forward your item to you.

I'm sure the seller will refund and then I'll leave her positive feedback. It's not her fault that she's ill., and mistakes do happen.
Yes I think the correct course would have been to go back via the seller but she's in hospital and it seemed better to do the right/honourable thing.

I do feel like that HC: shame on the other buyer. I know some people are just dishonest but you can't live your whole life avoiding the possibility can you? I'm going to stop worrying about this, get my refund, and carry on looking for my lovely shoes again. If I do find them for sale at her address though there may be 'a problem'.

the seller could ebay give the tracking info for the wrong item though - so you may not get a refund at all.

and yep you should have returned to the seller, then you could have opened a not as described case and given tracking to show the item had been returned. Standard signed for was insufficient if the item was £100 btw.

I have high hopes of getting the refund: what are the odds of 2 dishonest people in one three-way transaction? She's already given me the postage plus a fiver as she said she would.

BaG: they were irregular choice daisy dayz in a discontinued colourway.

I had a feeling they would be IC. I love mostly all of them. I'm sure they will come up again. The other buyer is a cock

Horribly poor show by the other buyer. Boo to them. Hope you get your refund OP and find the shoes again (not for sale by that miserable git that kept them for nothing).

I would have done what you did OP. The other buyer is a dishonest person who hopefully will get hers one day. Most people are nice on eBay but it seems to bring out the worst in others.

This is NOT an 'unsolicited mail' situation, surely? This is theft. Is it worth getting the police involved if eBay won't help?

the seller could pursue the other buyer I guess via small claims or with the police. Not sure where they would stand giving the other buyers address out to the OP tbh.

Technically the seller has a tracking number which says she delivered an item to you, therefore if you open a case of non receipt then she can enter the tracking number and the case will automatically be found in her favour.

What you should have done is opened a not as described case and returned the order to the SELLER via a tracked method. Then you would have been covered.

Hopefully the seller is honest and will refund you.

I feel sorry for the seller who is obviously trying to do the right thing for her buyers despite being in hospital. I'm sure you'll get your refund. Hope the other nasty buyer gets his/her come-uppance (is that a word?) at some point.

ebay should take the cost of the stolen item from the thief's paypal account (they can do that, can't they?)
