Buyer selling on item with my photos and description

Came across something I had sold a few weeks back being sold on by the buyer. Obviously not a problem at all, I always sell on things that are not suitable. What has really annoyed me is that she has used my exact photos and description word for word. I have had buyers do this previously and know that it is against eBay policy.
So, I contacted her and she apologised, said she didn't think it would be a problem, has no camera at the mo and would take down the photos and put her own description. Except she now can't as she has a bid on it. Told her only way she can sort it is stop listing and start again with her own info. She wants to know if I am really being serious, why does it bother me, they are no longer of use to me.

Hmm I'm not sure now if I'm being a bit ott, she is right in one way, but it is the fact that I spent the time and effort sorting the shoes, taking photos and listing them and I think it is bloody cheeky that she takes advantage of that.

What do you think I should do?

Had a look and she is also selling on something else that she bought recently and using the exact same photos and description.

She still hasn't left me feedback, but if she were to leave negative and something arsey because of this I could ask eBay to remove I'm guessing?

You own the copyright, so whether the words and images are of use to you, they are your's and she's not allowed to use them. Can you report her to eBay?

Yes I can. I have done previously with another buyer. It just really pisses me off, especially as she is insinuating that I'm being a bit ridiculous. Cheeky mare.

I can't see the issue with this tone honest.

If the picture is of the actual item being sold and the description is correct I wouldn't care.

It's not like plagiarising a novel you've written???

Tbh....I think that is a bit silly. I wouldn't care if somebody used my photos. Technically she's not allowed to, but I'd just drop it.

I giess what annoyed me more was that she was making out I was being unreasonable when I asked her to take down the photos etc.

you can report her for using your pictures and ebay will remove the listing. But she can sell on what she likes.

Block her as a buyer so she can't do this to you again. I would be cheesed off if that person hadn't even left feedback or asked if you don't mind her using your listing. If someone bought an item from me then found it didn't fit, if they asked me I wouldn't really mind but it is good manners to ask first I think.

Someone bought a dress from me and I saw it being listed for a great deal more in their ebay shop. I did then contact them to suggest they left me feedback as they were obviously happy with the item! Fair enough, re-sell but I felt a bit miffed they hadn't left me decent feedback for an item they thought was worth significantly more. I was very pleasant in my email though and they left nice comments. IME it never pays to lose it or get a bit tetchy however much you might feel like it.

Let it go - ebay can throw up some irritations but I would probably block.

It's against listing policy for a reason, which is that the item is potentially not the same as when you sold it. She may only have had it for five minutes but still, if she is selling it, the accuracy of the listing is her responsibility now and that means she needs to check it, double check it and list it in her own words using new images.

Also it is just bloody cheeky that you took the time and trouble to write it, and she can't be arsed.

One time someone bought a jacket from me, said they thought it was an odd fit no, that would be you being a funny shape and wanted to return it. I said no, I was really busy with a new baby and so sorry but if she wanted to list it herself, she was welcome to use my copy to make it quicker/easier.

It is NEVER Ok to do this without permission and she is just being lazy. Honestly though, it can't hurt you, the only thing is if she gets an unhappy buyer, she can't blame you if her/your description was wrong! So it's stupid of her really.

Report the listing and ask ebay to remove, but only once you've had feedback from her. If she won't leave any then I'd not risk it.

I really don't see this as a big deal. You have sold it - end of. (yes, I know the 'rules' but this is a bit petty.

FWIW, when I have resold unsuitable stuff, I leave feedback after the sale has gone though, in the hope of making a little more money - so if someone checks my recent feedback they cant see where it came from

you asked - its a second hand item you sold, eBay have lots of ridiculous rules, most of them designed to maximise money for eBay.

Why on earth does it bother you?

I did ask, no need to be rude though.

It bothers me for the reasons I have already stated. I spend time and effort taking photos & writing the description, and she just comes along, copy and pastes it all and thinks that's alright. In my book that is cheeky, others disagree. Totally fine. I asked and got replies, thank you.

Somebody I know realised that somebody on Ebay was linking to pictures on their web pages to help sell something. They changed the pictures on their web page to something inappropriate Grin
