Loan from family to buy out ex

Dear all My husband and I are splitting up. We have a lot of equity in the house. I could afford to pay the mortgage but not to buy him out of his share. One option I know is a Mesher order. However he will need to fund a new place to live so this would be a problem. My father is in a position to lend me the funds from savings/inheritance- it would be a substantial six figure sum but would not put his way of life at risk. My intention would be to downsize in about 4-5 years and repay the loan when the children are hopefully at uni etc. Has anyone done this? Did you put any sort of legal agreement in place?
