That doesn't get clawed back by the CSA does it or rolled over ?
I don't want more money out of him just something going forward .... He's not paid a penny for 6 months, prior to that he was paying child support plus half of child care so I could work which im no longer doing.

I think that you can get money through the csa but I think there's a fee for it - not sure if it's billed to him or you.

a private arrangement is better because there's no fees in it but if he is untrustworthy then it may be your only choice for the csa.

I'm not sure about backdating. I've never heard of it happening

No ... We had a private arrangement ... He was paying double what they are saying he should have paid but then it was only for 6 months of the year, so in total he's paid the right amount. Unless he gets them to backdate it. In which case he would be paying nothing for the next 6 months, does that make sense?

Has he said he will start paying again, or did he just stop out of the blue and you don't know where you stand? Was it agreed he pay double for 6 months and then nothing for 6 months?

With a private agreement anything can be paid. With the CMS it is a set amount. I would find out his plans asap and if he is not forthcoming, then apply to the CMS. Not sure if the CMS base everything on the Tax year - ie April-April as didn't go that route. I know that there are various options

The CMS won't backdate it. What happened in the past is irrelvevant to them, whether there was a private arrangement or whether he paid nothing at all ever.

He just stopped paying basically. Although he's paid double it was to force me to work to help him out so certainly not out of the goodness of his heart. I've applied to the CSA in march, they e sorted it all out and are taking it from his employer as soon as they can, I'm just worried they will say you've had this years ... Even though I haven't at all the child care provider had most of it and it wouldn't have been worth me working had I thought that might be the case.

That's good news squirrel ... He thinks it will and he also planned to deduct my share of the car loan ... That he currently drives around in ... Twat !

He doesn't get the idea of child maintenance, does he? That the money is to pay for stuff for HIS CHILD. Car loan Confused

IMO the good thing about the CMS is that it takes all the emotions out of it. They just look at the situation and apply their rules. There are no deals, you don't have to 'help him out', listen to him moan, etc.

He was shielded from the costs of his children by me throughout the marriage, I was thinking about this the other day, when I met him his mortgage was £850 a month, his bills the same, drove the same car etc. all the kids clothes, food, toiletries etc were paid for by me so this must be coming as a mighty shock for him ... The eldest is 13
