Can anyone advise - mediation has failed, now we are supposed to be negotiating between solicitors but I don't hold out much hope:( while these negations are going on (or not!!)can I still apply to court? Thank you:)

Short answer is yes. Either party (or solicitors on their behalf) can apply to court to resolve a dispute. However apart from the costs court proceedings can take 9 months or longer and damage long term family relationships more than necessary to the detriment of children's well being. Ultimately even most court cases are resolved by negotiation and agreement.

Thank you, I appreciate all the upset it could cause but tbh we are getting nowhere because the other party are only focused on what they want, compromise isn't a word they appear to understand:(
