Neighbours Fence -grr

I don't think IABU but DH seems to think I am.
Us & next door share a back boundary with another house. The owner of the other house wants a new fence (as the fence he put up himself blew down in the strong winds in winter). Next door neighbours have 6 panels in their garden ajoining the back boundary, we have 4. They have propsed to split the cost more or less 3 ways. I disagree as back neighbour wants the fence not us (our fence is still more or less intact as it was his panels that fell down) & he has 10 panels in his garden & we have 3.
DH is of the line 'anything for a quiet life'

Whose responsibility is the fence? If it is the back neighbour's responsibility and he put up the fence which has fallen down, then he is responsible for the whole cost. You can offer something to keep relations sweet.

Well back neighbour put solid panels onto the existing fence (which as our side has the posts, I think is ours/next door neighbours) - his panels were too heavy I guess & blew down in the wind. One of our posts were damaged. I don't mind paying a fair proportion but I don't want to pay over the odds just so he can get the fence he wants (which personally I think will blow down again in the first severe winds we have)

Hmm. Don't want to fall out with anyone but don't want to get fleeced. Our fence (as I understand it, if you have the posts on your land then its your fence) is still standing at the mo so personally I don't see why it should be replaced.

It completely depends whose responsibility the fence is. We have had to replace 2 sections of fence in the last few years and sod's law means that they were both our responsibility so we have paid for everything. If/when the third section goes I will expect our neighbours to take care of it as it is "their" fence.

Pay if it is yours. Don't pay if it is not. Simple

Think you need to check your Deeds - don't think which side the posts are is definitive.

On the Deeds there should be a T shape in the garden of who is responsible for the fence (think thats it anyway).

We don't have any T shapes on our Deeds but DP has agreed to pay half for a fence between us and neighbours which I totally disagree with. All fences apparently are our neighbours and the people behind. I don't see how that works but the solicitor pointed it out on purchase.
