Exactly what it says really..

Last week was driving to work in a city centre, very straightforward in my lane, along a straight stretch of road when the stupid cow to the left of me pulled hard over into the side of my car without waiting (or looking, you can only assume). Bang - caused £7k worth of damage to my car. Luckily no passengers (my 2 year old would often be right where she hit the car).

It was a very straightforward accident. And you know, don't you, if you have done that.

This lady has decided to claim to her insurance company that I drove into her lane. The photos, skid marks on the road (luckily it was a dry day) and CCTV all tell the insurance companies she's lying. But I'm seriously p*ssed off. Because the insurance companies have to follow whatever processes, I have to pay out on my excess until they refund it later on, to the tune of several hundred pounds and right before Christmas. I'm not particularly well off.

I'm just astonished and disgusted at behaviour like this. Would like to think if anyone I know did something like this they would be honest and issue a full apology rather than putting the driver they have smashed into through all the additional hassle that is caused by having to spend half a week gathering proof with the insurance company, council etc.

Getting a dash cam.. if anyone can recommend one..

I had this once, almost exactly as you describe. I ended up having to go to court as he would not back down. I think for him though he was an older gentleman and I was a woman in my 20's he felt he couldn't do any wrong!
I was very nervous but very much enjoyed my moment in court especially the judge telling him he was wrong! You should have seen his face!
It's stressful but if there is proof don't worry it will get sorted out.
However I think you will have to pay your excess either way won't you?

Yes but it will be refunded to you if your claim against the third party succeeds. It's a pain to wait, happened to me too but I got it back.

Urgh, this happened to us in a car park. A woman reversed the length of the car park into us. Then she claimed we had run up the back of her car.
Unluckily for her, I got the car park CCTV. I asked the insurance company what they were going to do about her fraudulent claim (we were insured by the same company). I could almost hear the shrug over the phone as he said that people do it all the time and there wasn't much they could do.

She will get it all back on her. When I claimed after being hit by a car (their fault, I was a bleeding pedestrian!) I had to sign the insurance forms saying that if I was found to be lying I had to pay an hourly rate for the solicitor out of my own pocket. Something tells me she's going to have a lot to pay - the solicitors fees I would have had to pay if I lied were £300+ an hour.

A similar thing happened to me. The woman produced a witness. There was no-one there, and I knew the accident was her fault, but my solicitor said the "witness" swung things too far her way and advised me to compromise on a 50/50 admission. She refused to accept that and said she wanted to go to court. The case took months to come up, and in the meantime she charged my insurance company a fortune for her courtesy car- which she insisted had to be a BMW. It went right to the last minute- I was literally sitting outside the courtroom looking forward to my chance to set the record straight- when my solicitor called to say the woman had accepted the 50/50 deal. We never found out why, but I guess her witness decided he didn't want to perjure himself for her.

This does happen unfortunately. Some people just can't stand being wrong. This happened to my mum. Driver pulled out of slide road into her but wouldn't admit it. They had to settle 50/50 in the end.

This happened to me too. I feel your pain. I was thinking about it today funnily enough, about 10 years after it happened! The stress was awful as i was young and strapped for cash and as he lied about the fact it was his fault meant that my insurance company wouldn't fund a hire car for me so i really struggled to get into work. All i can say is skip on with life and give the scumbag little thought. You'll get the money back in the end and karma will bite her in arse somehow.

YNBU! Some cow lady once did similar to my ex-dh many years ago. Was a crash for cash scheme. He stopped and asked if police or ambulance needed calling. No she said I'm fine. Until the insurance details later, she had every injury going and his insurance skyrocketed. She could prove he hit her. He couldn't prove she was speeding (she'd reversed into him in a car park on purpose at speed).

I watched something a while ago, I don't personally drive but isn't there a certain body you can report suspect fraudulent cases too now? They're usually quite good.

I must oojnt out this was several years ago though and I know they're a lot harder on cases now. As you say though, whether you get it back or not isn't the point it's still going to temporarily leave you without and just before Christmas too so you're DNBU.

I was once hit by another drive on a country lane, I saw him coming over the brow of the hill too fast on a wet road, stopped pulled over as far as possible, he saw me panicked and hit his breaks hard, he skidded into me. My Insurance company decided to agree it was 50/50 because it was a narrow road, I still fail to see how it was in any way my fault or what more I could have done as I was parked when he hit me. This story doesn't help the OP but I like to tell it occasionally.

Doobigetta that happened to my friends DS too. He had a knock. Fully accepted responsibility. Got out and swapped insurance details. Only bloke in the car driving. Miraculously there were two other passengers in that car who managed to obtain injuries without even being there!

A friend had similar - the other driver pulled out from being parked at the side of the road without indicating or checking his mirrors, whilst being on his phone. He initially was apologetic and admitted his fault, but ended up changing his story and trying to claim for whiplash and emotional trauma. He changed it a few times (different accounts to the two insurance companies), and the judge pretty much laughed in his face.

My mate was out of pocket in the short term, but got everything back. He was told that he could have chased for more, but he just wanted done with it.

YANBU my brother had his car written off when somebody pulled out a roundabout in front of him. They denied liability and eventually it had to go to court. It took 2 YEARS for him to get the money he was owed

I don't know make of my dash cam, I'll look in the car tomorrow, but go with swift insurance as they give 15% off premiums for having a dash cam. Plus I feel safe with it.
I also talk to it if I have lots to remember as can play it back.....

Ugh. Infuriating. I sincerely hope you have CCTV and picture proof and she gets what's coming to her.

I rear-ended a car a couple of weeks ago. They stopped suddenly in an intersection, without warning, when kids ran out in front of them in the dark then ran off. I didn't stop in time and skidded into the back of the other car. But guess what. My fault. I shouldn't have been as close as I was, obviously, so my fault. Just the way it is. The other driver could not have been more gracious about it, and I apologized. End of incident. My insurance company has sorted it.

Luckily, damage was minimal for both cars, no one was hurt, and my car has already been completely repaired.

Definitely get a dash cam OP. In a taxi on the way home today. Coming down a major main road. Someone did an emergency stop to let her passenger out then proceeded to do a 3 point turn. Bang in the middle of this major road. There was no traffic and no hurry for her to do it other than she thought she could. If it was another driver who wasn't suspecting she may stop dead in front of them they'd have caused a massive pile up.
