To think the CMS should fucking chase maintenance?

CMS have had some kind of system based cock up on my claim, meaning until it's unfunded nobody is allowed to do anything regarding it INCLUDING doing something about the fact the my ex has decided to pay less per month than he ought to pay per week.
Literally was just told "even if he stopped paying there's nothing we could do about it right now"
Aibu to think this is fucking shit?

Soubriquet Tue 22-Nov-16 14:11:05

It is shit

And the parent knows they can get away with it which is why they refuse to pay.

Manumission Tue 22-Nov-16 14:13:25

They're complete crap. So was CSA. There's no real will to have a system that works.

CremeEggThief Tue 22-Nov-16 14:16:26

YANBU. NRPs who don't pay should have it taken from their wages or benefits straight away.angry How many RPs go without new clothes and shoes and even food for themselves, to put their children first?

GinAndSonic Tue 22-Nov-16 14:17:00

I'm so angry.
And of course the reason he's cut the money is because he's cut his hours apparently, according to him anyway. The CMS said they haven't been able to sort any changes recently because of aforementioned cock up, so obviously when they do sort everything out he will only have to pay the reduced amount plus a tiny amount of arrears each month as (like I.was told last time he had arrears) they have to make sure it's affordable for the paying parent and that it doesn't cause him hardship.
Fuck the hardship we have though, obviously.

I hope he gets scabies. And gout. And chronic heartburn.

GinAndSonic Tue 22-Nov-16 14:19:09

Please note, he cut his hours in response to the child maintenance service calculating that his payments ought to increase from £170 per month to 220. He's now paying me 45 per month. For two children.

I'm sorry I'm just raging at you all, but I had to get it out somewhere I knew peoole would understand.

Soubriquet Tue 22-Nov-16 14:21:41

You gotta rant somewhere and here is perfect

smilingmind Tue 22-Nov-16 14:23:53

I found CMS amazing. They immediately got maintenance for my gs which CSA hadn't managed in 10 years.
The arrangement is that if a payment is missed the arrangement will be changed to being taken directly from the person's wages. In that case they will have to pay an extra 25% to cover costs.

Briarthorn Tue 22-Nov-16 14:28:55

They are rubbish. I've been waiting for the pittance from XH's benefits since June, which hasn't been paid due to computers and can't be backdated either. Even though I'm ringing every other week. You'd think a direct deduction from state money would be an easy one but no...

JellyBelli Tue 22-Nov-16 14:35:38

Its completely unacceptable. But doesnt surprise me.
In my case, the CSA sent me a bill for their services, and docked my benefits to pay me my maintenance. You cant make this shit up.

BarbarianMum Tue 22-Nov-16 14:39:18

YANBU I have never understood why the government places such a low priority on ensuring that both parents support their children.

GinAndSonic Tue 22-Nov-16 14:58:46

Smiling, I had found them great too. Until this year. When they clicked the button to send my letter and payment schedule in may after the annual review. And despite it being generated, it never got printed and sent. And all I'm getting told. Still. Is that there has been an issue with the system and it's not doing as it should and they are escalating it to someone who can unfuck it but in the meantime, fuck all they can do.

MAY. FUCKING MAY. The last letter I had from them is dated 28 April. Apparently it might not get sorted till it goes back to annual review.

And this 221 per month figure is from the annual review, which neither of us got in writing but have been told on the phone when calling to see where our payment schedules are.

What the fuck can possibly have been done wrong on their computer to fuck up my claim like this?

Newstome Tue 22-Nov-16 14:58:49

they are shit and a fucking joke

if the govt overpaid you the child benefit, i bet they will be there like a shot demanding the money back

GinAndSonic Tue 22-Nov-16 15:02:44

In an unrelated cock up. I got a letter from HMRC yesterday to Mr G Sonic, my address, exes NI number regarding the overpayment of tax credits and the payment schedule he's arranged with them.

His name is Mr X Sonic. Mine is Ms G Sonic.
He's never lived here I got this place 18 months after our split.
But yes. The government want their money back.

Sneakynamechage Tue 22-Nov-16 15:58:41

I think we should have a system like America. Don't pay, loose your license/jail/ garnishment and a back payment that you owe and will keep being garnished on until you pay up.

Manumission Tue 22-Nov-16 16:03:40

Unfortunately millions of children are still paying the price for the horrendous press the CSA got soon after its inception 20+ years ago. A strong 'dads driven to the brink by callous agency' narrative was formed and nobody had the balls to risk a rerun by cracking down or even using the full powers that exist already.

OhhBetty Tue 22-Nov-16 17:17:18

It's shit. The reason it's shit is because the majority of RPs are women. If it were predominantly men trying to get the maintenance their kids deserve then I bet it would be a very different story.

Bettersleepoutdoors Tue 22-Nov-16 17:19:46

What people fail to see is that so many hardworking men are being bled dry by grasping gold diggers.
wink
angry on behalf of so many RPs and their children.

CherryChasingDotMuncher Tue 22-Nov-16 19:00:30

It's fucking despicable, and it's women and children who suffer. Could you imagine having such a shit system if blokes were systematically being ripped off by their exes? Doubt it! I imagine there'd be no slicker system angryangry

AyeAmarok Tue 22-Nov-16 19:03:39

YANBU. They're shit and it's an absolute scandal that they are so horrendously ineffectual.

donners312 Tue 22-Nov-16 19:34:10

it is disgusting and if that wasn't bad enough even if you do get it, it is only a whopping 16% of the NRP salary anyway!!

Luckily the NRP gets to keep the remaining 84% for themselves whilst like pp said we bleed them dry!!!

43percentburnt Tue 22-Nov-16 19:44:28

The government could easily sort it, if they wanted to! I've said previously it should be the NRP responsibility to register, just like self employed. Fail to register = fine. No more than 200% of what is owed plus £100. This is chased for life.
Box is ticked, just like student loans. There is a reason the government don't let ex students voluntarily pay back their loan, instead it is deducted at source! Maintenance should be taken at source, just like student loans. All responsibility should be with NRP, or they incur a financial penalty, just like self assessment. Fucking ridiculous that a western government cannot resolve such a problem in a society with NI numbers, driving licenses, passports and electoral registers!

A while back mnhq asked opinions on CMS, did we ever get feedback? I've never had dealings with them but the system seems ludicrous.
